Citizens who experienced administrative segregation, a type of solitary confinement, in a Canadian federal penitentiary may be eligible to receive compensation thanks to a $28 million class action settlement, which includes three separate class action lawsuit claims.

The solitary confinement class action settlement Class includes two groups. 

The first group includes any individual who stayed in administrative segregation in a Canadian federal penitentiary for more than 16 consecutive days or more on or after March 3, 2011. 

The second group includes individuals who stayed in administrative segregation in a Canadian federal penitentiary for any length of time on or after July 20, 2009, were diagnosed with a mental disorder before or during incarceration, and suffered serious impairment as a result of their disorder.

The federal administrative segregation class action settlement specifically states it makes no difference whether the Class Member’s time in administrative segregation was voluntary or not.

In three separate class action lawsuit claims, plaintiffs allege inmates’ rights were violated when they were placed in administrative segregation. These human rights violations were allegedly committed against mentally ill inmates, too.

The Courts did make a decision regarding the human rights violations alleged in the federal administrative segregation class action. The Courts have concluded that the rights of inmates placed on administrative segregation while incarcerated in Canadian federal penitentiaries were violated.

Class Members who want to receive compensation in the solitary confinement lawsuit settlement must submit a claim

Class Members who do not file a claim will not receive any money. They will also give up their right to receive any compensation regarding this federal administrative segregation class action settlement in the future.

The amount of compensation each Class Member will receive hinges on the type of claim the Class Member submits. 

There are three types of Claims, known as “Tracks”. 

  • Track 1 Class Members will receive an equal share of the $28 million lump sum. 
  • Track 2 Class Members will receive at least an equal share of the $28 million lump sum and up to $50,000. 
  • Track 3 Class Members will receive at least an equal share of the $28 million lump sum, but more than $50,000. There is no limit to the compensation Track 3 Class Members can receive.

The deadline for Class Members to opt out and exclude themselves from the solitary confinement class action lawsuit settlement has already expired. 

Class Members may still be eligible to opt out if they were first placed on administrative segregation after Dec. 12, 2016, and they have not yet had an opportunity to opt out. This deadline is Oct. 7, 2021.

The deadline to file a claim is Sep. 7, 2022.

    I did not receive my medication that I should have been on.
    I supposedly had a visitor, sat in cubical for a hour when I did not have a visitor. Talk about messing with your mind and heart. A person did come in bit exited just as fast. It was not anyone I knew. My heart ached. My mind is being played with. Why would they do that? What did I do to deserve this? I was crying cause know one knew I was in there. I couldn’t remember anyone’s phone number. It was a fuckery from the beginning.
    The cops breached me and set me up.
    I had quit everything. Stopped selling, cooking and smoking it. (It being coke cooked into crack)
    Anyways, I called
    for assistance….my ex had took my valuables to sell so he could by some dt(being fentinal). I asked for assistance so I could get my personal belongings from him, before my stuff was all gone. While I was on the phone to the police, my exes buddy was yelling in the background, cops thinking it’s my ex,(which the courts had separated us) So i went home, not even 2 blocks away. The police were there within 5 minutes (record time, when do they ever come that fast?) So they wanted to come in and see if he was there. I complied and let them in. (Serve and protect) I thought cops went by. Anyways, I didn’t check my house before I let them in, so I had left out some Marijuana. (Wasn’t legal yet)so probable cause. Ever hear about good cop, bad cop? Well that was played on me…I had cleaned my house of all drugs, anything to do with drugs…(paraphinelia) bad cop whips out a little baggy that coke could be in. It had residue in it. They checked it and BAM!! I was arrested. Probable cause. I crushed my hydromorphine(pain medication)(which I snorted it) found it in a mortal and pestol….had some in it, did not check that assuming it was cocaine…. off to jail i go!!!! Those Mother f—ers!!! So wrong…. I asked my lawyer to check it and the judge to also check it..NOPE!!! over 21 days in jail for nothing…..I didn’t remember any phone numbers, know one knew I was incarcerated.
    They 3oild not give me my anti depressants. I was going mental. I have a chemical imbalance with manic depression, bi-polar…..I sure didn’t feel tight. Then being on lock down cause not enough employees and with colvid…..they could not keep there staff. And one girl brought in fentynal. They treated it like anthrax….I could ho on…..

    In 2001 I had my parole revoked, got beat almost to death in the correctional, then thrown in segregation for 5 or 6 weeks with no books no radio no TV. Just silence. I was pretty fucked up from the beating. But i never put it on the punk, said i fell out of my bunk. Three times. I put in requests for books and a radio. Pricks wouldn’t get one, I’m still messed up.

    Unbelievable.. Only in Canada, what about the victims. what do they get. Administrative segregation is protection for the Inmates and is nothing like Solidary Confinement which does not exist. Huge waste of resourses that will probably be wasted on Drugs and Crime again.

    I spent more than a year in isolation about 6 years ago I never had one serious charge not one fight never caught with a shank over a year they said I was a danger last month of my sentence they let me go back to population and I got nothing but high fives and hugs now I trust no authority figuures

    I was i incarcerated in grand Valley Fraser Valley institution my arrest history stems back to the age 15 my diagnosis include complex post traumatic stress disorder anxiety depression just to name a few during my years of incarceration from early on I was subjected to cruel and unusual punishment I was isolated and segregated from my peers for at one point 5 whole months I was bullied by the guards and told on multiple occasions to kill my self … I was incarcerated in segregation with terry baker the night the guards negligently allowed her to hang her self I was removed from the jail two days later to keep me quite I watched them pull the body out of her cell in hopes to resuscitate her to no avail and was lied to when they said she died in the hospital to cover their tracks I feel I would be another victim of this fate if I had not gotten released I suffer from agoraphobia because of this treatment I am unable to gain or keep stable relationships I’m always worried that CSCC or some government official is going to kill thought that may not be true these are the fears I live with because of my many days and nights locked in segregation I’ve slept on shitty floors my last seg placement was aug.2019 I had just got arrested and brought to the Lindsay jail they immediately after taking a confirmed pregnancy test through me in a unkept cell with no water and faeces on the wall if I had not spoke out at court I believe I would not of gained bail and they would of killed me . I’m done being silent I want my voice to be heard if not for the money so this inhumane treatment ends it really messed up my life and I’m lucky to still have a head on my shoulders cause at one point I feel I was truly loosing my mind in this system . Thank you for helping us gain Justice please continue because there’s a lot to be spoken for .

      My husband is just finishing this 12yr sentence and was held for 2 1/2yrs in seg during trial and sentencing for his offences in Ontario and he had a similar Thing happen where they knew the guy in a seg cell beside him was suicidal and crying all week he couldn’t take the abuse anymore and wanted to die and my husband had to listen to that and then listen to him hang himself and the guards then left him hanging for 2 days in that cell beside my husband. I feel for so many of you. He will never be the same and no amount of money will ever help and he has psychosis episodes and ptsd and anxiety, ocd disorder just to name a few. The system is more corrupt and evil then the people they hold within its walls.

        You are so Correct on so Many Levels. I do recommend that you should call a lawyer and explain all this to see if you can sue. You would have to search what kind of lawyer cause I’m not sure. 💜

    I was incarcerated in prison in 1981. I was released on September 2021. I spent 10 years in the special handling unit. Off and on I spent another 5 to 8 years in segregation. I’ve seen a lot of things. I have experienced a lot of things. I am not the same person. I have been greatly affected by the inhumane treatment that I’ve received over the years. I will not go into any gory details. I will not dramatize my experiences. People need to understand that it’s not just prison it’s the levels of Prisons within the prison and the mentality of those people working in those prisons.
