Frères du Sacré-Coeur - sexual abuse settlement - Brothers of the Sacred Heart

Victims of alleged sexual abuse by Frères du Sacré-Coeur, or Brothers of the Sacred Heart, across Quebec may be eligible to benefit from a $60 million class action lawsuit settlement.

The Class includes anyone who was sexually assaulted by a religious member of the Frères du Sacré-Coeur anywhere in Quebec. Liquidators of the estate of a Class Member who died on or after Sept. 28, 2013, may also file a claim.

The plaintiff in a class action lawsuit filed in 2016 alleged sexual abuse was rampant at the school, the plaintiff himself claiming he ad been sexually abused more than 300 times while at Mont-Sacré-Coeur College.

The Frères du Sacré-Coeur is a Roman Catholic missionary order operating several institutions across the province. 

The exact amount of each Class Member’s payment is not known at this time, but several steps are required as part of the claims process.

The claim form requires Class Members to describe the sexual acts they suffered, when and where these incidents took place, and, if known, the name of the person who committed those acts, among other information. They also must describe the damage they suffered, such as anxiety, depression, post-traumatic stress disorder, etc.

Further requirements for making a claim are outlined on the sexual abuse settlement claim form.

Claimants also will be required to meet privately with an arbitrator via video or in person.

The arbitrator will then determine whether the Class Member is entitled to compensation and, if so, whether they are entitled to basic compensation or level 1 or 2 extraordinary compensation.

Different amounts correspond to the different levels.

The “basic compensation” level will be used as the basis of the calculations for the other levels.

Level 1 “extraordinary compensation” will be 40 percent higher than the basic compensation, while Level 2 will be 80 percent higher than the basic compensation.

Cases involving deceased Class Members will be entitled to 50 percent of the basic compensation amount.

Level 2 extraordinary compensation claims are capped at $500,000; this amount could be lowered depending on the number of valid claims filed.

The arbitrator’s decisions will be final, binding, and not subject to appeal.

The Court approved the Brothers of the Sacred Heart sexual abuse class action lawsuit settlement Sept. 2, 2021.

Claims must be submitted via email, fax, or registered mail by July 30, 2022.

Who’s Eligible
