ParaMed agreed to a $195,000 settlement to resolve claims that it failed to follow the proper sterilization procedures at its clinics, resulting in patients contracting serious infections such as HIV.
The settlement benefits patients who received wound care involving the use of medical instruments at ParaMed’s clinics at 124 Barker St., 1340 Huron St. and 148 Fullarton St., Suite 200, in London, Ontario, between Jan. 1, 2008, and July 27, 2018, who ParaMed contacted and informed that they may have been exposed to viral infections and who later tested positive for hepatitis B, hepatitis C and/or HIV.
The class action lawsuit claims ParaMed failed to properly sterilize the instruments used at its three wound-care clinics in London. As a result of the allegedly unsterilized tools, patients were exposed to the risk of contracting serious diseases, such as hepatitis B, hepatitis C and HIV.
ParaMed is a home health care service provider.
ParaMed hasn’t admitted any wrongdoing but agreed to a $195,000 settlement to resolve the infection class action lawsuit.
Under the terms of the settlement, class members can receive a cash payment based on any infections they suffered.
Claimants can recover $15,000 for hepatitis B infection, $10,000 for hepatitis C infections and $25,000 for HIV infections. Payments may be reduced pro rata if the value of claims filed exceeds the available funds.
The deadline for exclusion was March 15, 2021, following the certification of the class action lawsuit.
The court granted this settlement final approval on Sept. 29, 2023.
In order to receive a settlement payment, class members must submit a valid claim form by Jan. 30, 2024.
