Citizens who experienced administrative segregation, a type of solitary confinement, in a Canadian federal penitentiary may be eligible to receive compensation thanks to a $28 million class action settlement, which includes three separate class action lawsuit claims.

The solitary confinement class action settlement Class includes two groups. 

The first group includes any individual who stayed in administrative segregation in a Canadian federal penitentiary for more than 16 consecutive days or more on or after March 3, 2011. 

The second group includes individuals who stayed in administrative segregation in a Canadian federal penitentiary for any length of time on or after July 20, 2009, were diagnosed with a mental disorder before or during incarceration, and suffered serious impairment as a result of their disorder.

The federal administrative segregation class action settlement specifically states it makes no difference whether the Class Member’s time in administrative segregation was voluntary or not.

In three separate class action lawsuit claims, plaintiffs allege inmates’ rights were violated when they were placed in administrative segregation. These human rights violations were allegedly committed against mentally ill inmates, too.

The Courts did make a decision regarding the human rights violations alleged in the federal administrative segregation class action. The Courts have concluded that the rights of inmates placed on administrative segregation while incarcerated in Canadian federal penitentiaries were violated.

Class Members who want to receive compensation in the solitary confinement lawsuit settlement must submit a claim

Class Members who do not file a claim will not receive any money. They will also give up their right to receive any compensation regarding this federal administrative segregation class action settlement in the future.

The amount of compensation each Class Member will receive hinges on the type of claim the Class Member submits. 

There are three types of Claims, known as “Tracks”. 

  • Track 1 Class Members will receive an equal share of the $28 million lump sum. 
  • Track 2 Class Members will receive at least an equal share of the $28 million lump sum and up to $50,000. 
  • Track 3 Class Members will receive at least an equal share of the $28 million lump sum, but more than $50,000. There is no limit to the compensation Track 3 Class Members can receive.

The deadline for Class Members to opt out and exclude themselves from the solitary confinement class action lawsuit settlement has already expired. 

Class Members may still be eligible to opt out if they were first placed on administrative segregation after Dec. 12, 2016, and they have not yet had an opportunity to opt out. This deadline is Oct. 7, 2021.

The deadline to file a claim is Sep. 7, 2022.

Who’s Eligible

        Yes people broke the law but they are still human and need to be treated as such. Your incarcerated to do your time for your punishment not to be raped and beaten or starved days or months on end. No matter what anyone says this is not okay on so many levels. All humans are entitled to their rights and respect.

    I was locked up in the calgary remnd center for almost three and a half years and 2 and a half years of that where on unit 9 administration segregation while there they placed a pedafile beside me that had raped over 300 boys and I was one of them when calgary city police came to see me they started by showing me pictures of all these boys I was very appalled by this as I seen lots of pictures of others that I had known including my stepson so while being there the psychology guy that would do his rounds to ask how every one was doing would pass right by my door not even the consideration of asking me how I was doing but sure enough he would stop at the pedafiles door and talk for hours I have been so fucked up by this that It became a lifetime of in and outs for 32 years because I lost all respect for the law because of what they put me through I still suffer today with a magnitude of problems inside my head that I don’t even know where to start to talk about or how to even change the way that they have made me become I’ve lost so many thing so many people and the most important thing my mind on how it could be left to go on for so long and not knowing if I want to make it through to tomorrow BH

    I was placed in segregation a few times ,one time they actually brought me to the hospital and had a doctor cavity search me vaginally as well as in my rectum ! How shocked the Doctor was at this and how I have felt ever since then ! It was beyond degrading and I only agreed for an X-ray not a cavity search ! I was diagnosed with bipolar disorder and I do go into stress induced seizures and I have experienced some extreme confusion and horrific Psychosis afterward. Being sent to segregation for nearly a month for suspicion is not enough to place someone in inhuman places where you also hear and see unjustly things being said and done to others who are also in segregation for reasons like “ your close to your warrant and we think your packing “ Or you were involved in making “brew” so you will be stripped of your human rights , denied phone calls and even made to strip infront of ,told to “sit down and spread your legs”this is how they conduct strip searches ! As well having to sit in your cell with cameras on 24/7 no flushing toilets no nothing that can possibly hide or rid of a “ package” Once your labeled as a federal prisoner it’s like you just lost your rights as a human ,your dignity is gone ,you are so defiled and made feel like you are lesser then in so many ways! I was transported to Nova institution from Mirimichi Jail by one male Guard alone in a car just him and I and I was completely terrified! Up to this day I have ptsd considering all circumstances

      I was in seg in Sharps farm seg for 5yrs SHU 4yrs in the 90s and 2000s and the shit they did was torture plain and simple. Double door daily … no power for weeks … piad assaults … and worst of all fake outside charges to add time to your bit and there was nothing you could do about it. Because when a gaurd claims you hit them and they charge you what judge is gonna belive you that it was a set up and never happend?

    I spent 16 months in federal confinement .I asked to be released but they refused ,and kept me there,at the same time took my matress and clothes and I was only allowed 10 squares of toilet paper at
    A time clothes washed every 2 weeks,showed 1 a week.

    Hey I was locked up so long in the Diss Cells,the real Solitary Confinement,for so long over two years.I stopped counting the days.Sure I escaped from the hospital in downtown Kingston from my escorts.And thus the Hole. I was just trying to embarrass the administration.Of that I am happy to say I was successful.To bad I paid for it with my sanity.Luckily the incident was reported in the Kingston Whig Standard.So they can’t deny that it happened.Google it Robert Alan Brule.Just like the guard said”walking down the street as if hadn’t a care in the world”

    Incarceration is the punishment you don’t go there so they can punish you by locking you up in your cell for days on end.. the correctional officers are pieces of shit and I hope this is rubbed in their face

      I feel the need to say Anne I know where your comming from and I understand your point but prisoners aren’t sentenced to be abused and defiled we are supposed to be sent to try to prison one to pay the price but also the book of law states that going to any institution of imprisonment is to be rehabilitated if the offender is willing and ready to receive the help ! We are there sentenced to time to be taking away from our freedom but not our human rights ! Some of us end up there due to an unfortunate circumstance or due to a drug addiction bringing us to doing things we normally would never do but being under the influence or out of fear we commit crimes that the judge has sentenced us to pay the price again by taking our freedom ! There is no law that allows anyone working in Canadian prisons/ institutions to take our humanity from us !
