Cassels Brock & Blackwell agreed to pay $8.25 million to resolve claims it negligently promoted the Athletic Trust of Canada timeshare, losing Canadians money.
The settlement benefits individuals who applied and were accepted to be beneficiaries of the Athletic Trust of Canada in 2000, 2001, 2002 or 2003 who received and donated timeshare weeks to Registered Canadian Amateur Athletic Associations with a cash donation.
According to plaintiffs in the timeshare class action lawsuit, Cassels Brock & Blackwell negligently supported the Athletic Trust of Canada’s timeshare scheme by offering inaccurate legal opinions. These misrepresentations allegedly resulted in beneficiaries losing money.
The Athletic Trust of Canada scheme reportedly allowed taxpayers to “donate” cash to athletic associations for tax credits.
Cassels Brock & Blackwell hasn’t admitted any wrongdoing but agreed to resolve these allegations with an $8.25 million class action settlement.
Under the terms of the timeshare settlement, class members can receive a proportional share of the net settlement based on the amount they donated in cash to the Athletic Trust Program.
The first round of settlement payments will distribute funds to donors, while the second round of checks will be distributed to class members who cashed their first checks.
There is no exclusion or objection deadline for this settlement.
The final approval hearing for the settlement was held Jan. 20, 2023.
Class members do not need to file a claim to benefit from the settlement. Class members only need to take action if they received information from the administrator that is not correct.
The deadline to provide, correct or modify information is May 15, 2023.
