Janssen Pharmaceuticals agreed to pay $1.5 million to resolve claims Invokana and Invokamet can have serious side effects that may result in kidney injuries and lower limb amputations.
The settlement benefits Canada residents who were prescribed Invokana, Invokamet and/or Invokamet XR before June 21, 2022, and who experienced a diagnosis of acute kidney injury or acute renal failure before April 25, 2016, a diagnosis of diabetic ketoacidosis before Aug. 31, 2016, or a lower limb amputation before Dec. 6, 2017.
According to several class action lawsuits, Janssen knew its Invokana and Invokamet medications could cause serious side effects but failed to warn consumers. The plaintiffs claim the diabetes medications can increase the risk of lower limb amputations, ketoacidosis, acute renal failure, acute kidney injuries and even death.
Invokana, Invokamet and Invokamet XR are type-2 diabetes medications from Janssen. Janssen and parent company Johnson & Johnson have been accused of hiding serious side effects associated with Invokana and the other drugs in order to increase their profits.
Janssen and Johnson & Johnson haven’t admitted any wrongdoing but agreed to a $1.5 million settlement to resolve the class action lawsuits.
Under the terms of the settlement, class members can receive a cash payment based on their documented injuries linked with Invokana or Invokamet.
Payments will be determined by assigning point values to injuries and using those points to calculate a proportional share of the net settlement fund. For example, acute kidney injuries are assigned eight points, while leg amputations above the knee are assigned 32 points.
There is no exclusion or objection deadline for the settlement.
The settlement was granted final approval in Saskatchewan on Sept. 29, 2022, in Quebec on Nov. 23, 2022, and in Ontario on Sept. 30, 2022.
The deadline to submit a claim in the Invokana side effects settlement is Aug. 14, 2023.
