CarePartners agreed to pay $3.44 million to resolve claims its outdated cybersecurity led to a 2018 data breach. 

The settlement benefits Canadian individuals who were patients, non-unionized employees and contractors of CarePartners between Jan. 1, 2010, and June 11, 2018 and whose information was compromised by the 2018 data breach.

CarePartners is a hospital that specializes in post-acute care such as rehabilitation, home health, adult care and hospice. The hospital was previously four separate organizations and is now a part of the Mission Health system.

In June 2018, CarePartners’ systems were reportedly accessed by a third party — compromising the information of over 4,500 employees and contractors in addition to 237,000 patients. Hackers allegedly sent a portion of this information to the Canadian Broadcasting Corp. (CBC) and kept the rest in an attempt to extort a ransom payment from the healthcare company. 

Affected patients and employees took legal action against CarePartners, arguing the healthcare provider had a duty to protect their sensitive information. Plaintiffs say hackers were able to steal their data due to CarePartners’ outdated and insufficient cybersecurity measures. 

“[CarePartners’] cyber security protective measures, if any, were antiquated, inadequate, unreasonable, and readily penetrable by third parties,” the data breach class action lawsuit contends. “CarePartners even failed to encrypt the Personal Information stored on its computer network, which was a patent breach of the relevant standard of care that it was obliged to meet to protect the Class Members’ privacy.”

CarePartners hasn’t admitted any wrongdoing but agreed to a $3.44 million class action settlement to resolve these allegations. 

This settlement amount is based on reports that at many as 80,000 individuals had their information compromised by the data breach. If fewer than 45,000 such individuals are identified by the data released to CBC, the total settlement fund may be reduced to $2.44 million.

Under the terms of the CarePartners data breach settlement, class members can receive compensation for their data being compromised in the data breach. 

Payments will vary depending on the number of claims filed and the net settlement fund after deductions. According to the settlement website, payments will be at least $25.

The deadline for exclusion is Dec. 12, 2022. 

The CarePartners data breach settlement was certified March 2, 2022.

In order to receive settlement benefits, class members must submit a valid claim form by Jan. 11, 2023.
