Canadian Armed Forces benefits class action lawsuit overview: 

  • Who: The Federal Court has certified a class action lawsuit filed by a group of Canadian Armed Forces veterans against the Government of Canada. 
  • Why: Veterans argue the Government of Canada gave them bad advice that cost them benefits through its Supplementary Retirement Benefit program. 
  • Where: Nationwide. 

A class action lawsuit has been certified by the Federal Court that had been filed against the Government of Canada by a group of around 10,000 Canadian Armed Forces veterans arguing they were given bad advice that cost them benefits. 

The group of veterans had suffered devastating injuries and illnesses resulting from their time in the Canadian Armed Forces but allege they were provided “erroneous” advice by the administration of the Earnings Loss Benefit and the Supplementary Retirement Benefit. 

The Government of Canada established the Supplement Retirement Benefit program in order to provide compensation for retirement benefits and lower pension earnings for veterans “unable to engage in suitable gainful employment” due to injuries incurred while deployed, according to a news release

The program was reportedly aimed specifically at armed forces veterans who were “totally and permanently incapacitated” by the injuries they suffered while deployed. 

Veterans argue benefits program was too complex to navigate

The veterans are arguing that the benefits program was too complex and difficult to navigate for them to be able to properly take advantage of it — particularly for those suffering from cognitive and physiological injuries, according to the news release. 

Veterans argue further that workers employed by Veterans Affairs Canada “lacked sufficient training, expertise, and awareness of the various benefit programs,” including the Supplementary Retirement Benefit program. 

As a result, Veterans received erroneous advice about the Supplementary Retirement Benefit and related benefits and, consequently, did not receive the full value of the benefits to which they were entitled,” states the Canadian Armed Forces class action news release. 

A separate class action lawsuit was filed against the Canadian government in May by an individual claiming it failed to protect children from being sexually abused by a priest in the Canadian Armed Forces.
