The Assembly of Manitoba Chiefs (AMC)- First Nations Family Advocate Office filed the class action lawsuit on behalf of First Nations children, their families, and First Nations they argue were failed.

Eighty percent of the 11,000 children in Manitoba’s child welfare system are First Nations, with the amount of apprehensions of First Nations children due to “discriminatory practices,”  according to the a news release announcing the First Nations class action.

The First Nations Family Advocate Office claims that the majority of the children in Manitoba’s child welfare system were “apprehended off-reserve,” including 61% of children from the Northern Authority and 75% from the Southern Authority.

The assembly is requesting the Government of Manitoba and the Attorney General of Canada put a stop to “discriminatory practices” and for them to provide “properly funded services for First Nations children.”

AMC requesting $1 billion in compensation for First Nations, First Nations children and families

A total of $1 billion in compensation is also being requested for First Nations and First Nations children and their families over alleged damages caused by the child welfare system since 1992.

The AMC is also asking for “recognition that the wellbeing of First Nation children must be entrenched in First Nations laws relating to the wellbeing of First Nations children and families.”

“As our class action clearly states: Manitoba and Canada’s disastrous management of child welfare in this province perpetuates a longstanding effort to assimilate First Nations children,” said AMC Deputy Grand Chief Cornell McLean, in a statement.

In July, the federal government of Canada agreed to pay $20 billion to resolve claims it had underfunded the child welfare system for First Nations children.
