Altria vaping class action lawsuit overview: 

  • Who: The B.C. Supreme Court declined an application Altria Group submitted to stay or dismiss a class action lawsuit against itself and JUUL Labs. 
  • Why: Altria argued there was no connection between itself and British Columbia while the court determined that Altria is aware that its vaping products are unsafe regardless of location. 
  • Where: The vaping class action lawsuit was filed in British Columbia. 

The B.C. Supreme Court declined to dismiss or stay a class action lawsuit accusing Altria Group of conspiring with JUUL Labs to sell nicotine vaping devices to youth to “convert them into smokers.” 

Altria, which has a 35% stake in JUUL, requested that the complaint be stayed or dismissed while arguing that “there is no real and substantial connection between (Altria) and British Columbia,” The Lawyer’s Daily reports. 

The vaping class action lawsuit was reportedly filed against JUUL and Altria in September 2019 following the release of a Health Canada advisory that warned about adverse health effects caused by vaping. 

In declining to dismiss the Altria class action, the court determined the company “knew the product was unsafe, particularly for young people” but that it still “engaged in a marketing campaign” targeting them, The Lawyer’s Daily reports. 

Among other reasons for the decision to dismiss, the court also determined that Altria “misrepresented the safety of the product and failed to provide warnings of the dangers of using the product.”

JUUL faces numerous complaints over marketing, sale of vaping products 

In 2021, Health Canada proposed regulatory changes aimed at imposing a limit on the amount of nicotine concentration a vaping product could have and the flavour options for tobacco and cannabis vape products, The Lawyer’s Daily reports. 

JUUL faced a number of complaints in recent years revolving around its sale and marketing of vape devices. The company stopped advertising in the United States I’m 2019 and reportedly has also since discontinued the majority of its flavours. 

The U.S. Food and Drug Administration reportedly prepared an order to remove JUUL’s vape products from the market earlier this year after previously asking vaping companies to submit an application explaining why they should be allowed to sell their product. 

Meanwhile, JUUL agreed to pay $438 million last month to resolve claims brought against it by a total of 34 states and territories that revolved around the sale and marketing practices for its vaping devices.
