Technology price-fixing class action lawsuit overview: 

  • Who: Graeme Honeyman and Sylvia de Bellefeuille filed a class action lawsuit against NHL Spring Co. Ltd. and TDK Corporation. 
  • Why: Honeyman and Bellefeuille claim NHL Spring and TDK Corporation engaged in price-fixing for computer parts. 
  • Where: The class action lawsuit was filed in British Columbia court. 

A class action lawsuit filed against two Japanese companies and one of their U.S. subsidiaries over claims they engaged in price-fixing for computer parts has been certified by a British Columbia court. 

Plaintiffs Graeme Honeyman and Sylvia de Bellefeuille claim Japan-based NHL Spring Co. Ltd. and TDK Corporation were both overcharging consumers and price fixing suspension assembly computer parts, reports The Lawyer’s Daily

Honeyman and Bellefeuille reportedly argue that the companies overcharging “passed through the supply chain to purchasers of computer products across Canada.” 

NHL Spring Co and TDK Corporation both controlled the assembly market and colluded in order to increase the market prices for them, according to the technology price-fixing class action. 

“Their Assemblies were incorporated in products manufactured by some of the world’s largest technology companies and made their way into Canada through predictable supply channels,” states the technology class action, reports The Lawyer’s Daily. 

Plaintiffs claim similar class action lawsuits conducted outside of Canada

Honeyman and Bellefeuille argue that their class action lawsuit is different from other similar class certifications due to the fact that the complaints against other companies were done outside of Canada.

Further, Honeyman and Bellefeuille reportedly claim that, because the assemblies make up such a little amount of the products they are used, that  “there is no realistic prospect of tracing and quantifying any alleged overcharge passed through the complex global supply chain into the Canadian market.”

Honeyman and Bellefeuille are seeking damages for a class period between the time periods of January 2003 and April 2016 and claim the companies are guilty of unjust enrichment and civil conspiracy, reports The Lawyer’s Daily. 

Earlier this year, ELNA and Holy Stone agreed to pay $3.3 million in order to resolve claims the companies engaged in price-fixing for film and electrolytic capacitors.
