Consumers in Canada can collect cash payments from a Mercedes-Benz class action settlement resolving BlueTEC emissions claims.
The settlement benefits current and former Canadian owners and lessees of certain Mercedes-Benz BlueTEC II vehicles from model years 2009 to 2016 as of Dec. 8, 2021. A full list of affected models and model years is available on the settlement website.
Mercedes-Benz offers BlueTEC diesel vehicles as a way to combine the perks of a luxury vehicle with the benefits of “clean diesel technology,” according to the brand’s website. BlueTEC vehicles purportedly use high pressure fuel injection, turbocharging, and a proprietary exhaust solution to reduce emissions.
Despite high hopes surrounding BlueTEC II vehicles, Mercedes-Benz customers were disappointed by the actual emissions from their vehicles. A 2016 class action lawsuit challenged the technology and alleged that BlueTEC II vehicles emitted more nitrogen oxide than expected.
In fact, the vehicles allegedly put out more nitrogen oxide than allowed under environmental emissions laws. According to the class action lawsuit, consumers were duped into paying a higher price for these vehicles based on false emissions promises.
Mercedes-Benz hasn’t admitted any wrongdoing but agreed to settle the claims against it with a Canadian class action settlement. The company also agreed to a U.S. settlement over similar claims, though this deal is separate from the Canadian resolution.
Under the terms of the Canadian Mercedes emissions settlement, current and former owners and lessees can recover cash payments. These payments are subject to a 10 percent levy under provincial laws for Ontario’s Class Proceedings Fund (CPF).
Current owners and lessees will be eligible for a cash payment if they install the provided field measure free of charge. This measure modifies vehicles’ emissions control systems to allow the cars to meet promised emissions standards. Class Members who have this field measure installed can collect a cash payment of $2,925, or $2632.50 after the CPF levy.
The field measure may result in performance changes and regulatory reclassifications as the emissions system changes. Further payments of hundreds of dollars may be available for current owners and lessees depending on a number of factors including potential regulator decisions, emissions reclassifications, and performance factors.
Current owners and lessees whose vehicles cannot support the field measure can collect up to $1,672, or up to $1,504.80 after the CPF levy, based on the model years of their vehicles.
Former owners and lessees can collect cash payments of $835, or $751.50 after the CPF levy.
The deadline for objection was Feb. 2, 2022.
The final approval hearing for the Canada Mercedes BlueTEC emissions settlement is scheduled for Feb. 9, 2022.
In order to receive a payment from the settlement, former owners and lessees must submit a valid claim form by March 23, 2022. Current owners and lessees have until May 1, 2023, to have the field measure installed in their vehicles and to submit a valid claim form for payment.

Proof of Purchase
A copy of your driver’s license or other government-issued photo identification, the repair order or invoice you received at the time the Field Measure was installed in your Eligible Vehicle, proof that you owned or leased the Eligible Vehicle. Permitted documentation to prove ownership or lease includes your bill of sale, lease agreement, title, registration from time of purchase or lease, Ministry of Transportation registration history, financing agreement, insurance documentation listing your date of purchase or lease, or proof of lease payment. Your documentation must show the date you acquired or leased the Eligible Vehicle.

Have had the field measure installed. Immediately the vehicle did not start as readily as before. Called Mercedes dealership who performed work and said they have had other comments regarding the issue. This was done in July 2022 and have heard nothing back. Contacted Mercedes Canada and was referred to dealership. Very much a waste of time. I have received the payment.
Field measured performed april 2022, filed claim may 2022….still no payment…..what is happening….why so long to send cheque.

I have submitted a claim in May 2022 and received confirmation of my claim number but have not heard anything. I do know someone whoc submitted after I did and they have received a cheque. Not sure what is going on.
Had field measure installed on GLK250 early feb 22. Still no check. No one seems to know what’s going on. Next car will be an EV for sure now
Still can even book to get my field measure. It has been months. It takes 1.5 weeks in the shop so I think they have parts not people

The Claims Administrator has begun distributing payments for the MB BlueTEC II Canadian Settlement. Claims will be paid on a rolling basis in accordance with the terms of the Settlement Agreement which require us to wait until all Former Owner or Lessee claims are processed and validated before your Current Owner/Lessee payment is issued. Claims are being processed as expeditiously as possible. Please be patient.
Settlement checks will be sent via USPS mail to eligible Claimants to the most current address on record.
The former owners had a deadline of Feb 22 to submit. You would think by now they would have made payment. They just need match VIN numbers of former owner claim vs current owner claim to figure out payment. Nothing like a simple Excel Worksheet can’t go.

How can one follow up that a field measures claim form has been received. As well a time frame to received a settlement. It seems very difficult to contact anyone that can provide the above information
