Consumers in Canada can collect cash payments from a Mercedes-Benz class action settlement resolving BlueTEC emissions claims.

The settlement benefits current and former Canadian owners and lessees of certain Mercedes-Benz BlueTEC II vehicles from model years 2009 to 2016 as of Dec. 8, 2021. A full list of affected models and model years is available on the settlement website.

Mercedes-Benz offers BlueTEC diesel vehicles as a way to combine the perks of a luxury vehicle with the benefits of “clean diesel technology,” according to the brand’s website. BlueTEC vehicles purportedly use high pressure fuel injection, turbocharging, and a proprietary exhaust solution to reduce emissions.

Despite high hopes surrounding BlueTEC II vehicles, Mercedes-Benz customers were disappointed by the actual emissions from their vehicles. A 2016 class action lawsuit challenged the technology and alleged that BlueTEC II vehicles emitted more nitrogen oxide than expected.

In fact, the vehicles allegedly put out more nitrogen oxide than allowed under environmental emissions laws. According to the class action lawsuit, consumers were duped into paying a higher price for these vehicles based on false emissions promises.

Mercedes-Benz hasn’t admitted any wrongdoing but agreed to settle the claims against it with a Canadian class action settlement. The company also agreed to a U.S. settlement over similar claims, though this deal is separate from the Canadian resolution.

Under the terms of the Canadian Mercedes emissions settlement, current and former owners and lessees can recover cash payments. These payments are subject to a 10 percent levy under provincial laws for Ontario’s Class Proceedings Fund (CPF).

Current owners and lessees will be eligible for a cash payment if they install the provided field measure free of charge. This measure modifies vehicles’ emissions control systems to allow the cars to meet promised emissions standards. Class Members who have this field measure installed can collect a cash payment of $2,925, or $2632.50 after the CPF levy.

The field measure may result in performance changes and regulatory reclassifications as the emissions system changes. Further payments of hundreds of dollars may be available for current owners and lessees depending on a number of factors including potential regulator decisions, emissions reclassifications, and performance factors.

Current owners and lessees whose vehicles cannot support the field measure can collect up to $1,672, or up to $1,504.80 after the CPF levy, based on the model years of their vehicles.

Former owners and lessees can collect cash payments of $835, or $751.50 after the CPF levy.

The deadline for objection was Feb. 2, 2022.

The final approval hearing for the Canada Mercedes BlueTEC emissions settlement is scheduled for Feb. 9, 2022.

In order to receive a payment from the settlement, former owners and lessees must submit a valid claim form by March 23, 2022. Current owners and lessees have until May 1, 2023, to have the field measure installed in their vehicles and to submit a valid claim form for payment.

    1. AK says:

The Vancouver MB shop was begging me to get the field measure repaired. The shops get hood payment for their work from MB Canada. Remember these are dealers, they want to do the repair. Keeps the shop busy and money for the dealer.

  2. henry says:

My appointment was cancelled once and rescheduled by mercedes 2 months out and they called again and said they wanted to reschedule again another 2 months away because they don’t have parts…nobody return calls and are very poorly dealing with an issue they created and were suffering from.

    1. Sami says:

I also regret that I accepted to install the field measure. I did receive the check of $2700 Canadian dollars. Since modified the parts and software, my car has engine light ON every 2 months. Latest issue now with EGR and sensor. Dealership doesn’t want to fixed, no customer support , and I’m stuck with broken car. To book an appointment 3 months waiting time. Also backlog for part 1 year. So now I’m stuck with a car which I paid over $80.000 . But someone it will pay the price…….

      1. Leandro says:

Got the same problem! At soon the recall was fixed I spent over 6000$ of eclxtra repairs… and now I got the EGR valve or cooler valve problems!

  3. Sami says:

Why there is no answer to the questions. I just dropped today my car at dealer ti fix the problems.

  4. David says:

I am an Former ML owner and I just know about this. However, the deadline already passed March, 2022. What can I do? Thank you!

  5. Nazmi Said says:

Installed field measurement Jan 2022, when I should expect when to expect a cheque?
    Thanks

    BlueTec.
Please advise status, and as to when we should receive payment.
    Look forward to your reply.

  7. Kenneth May says:

I had the field measure installed on my 2 vehicles in late March, 2022 and filed our claims late March 2022. How long will it take to receive payment?

  8. V armstrong says:

I had my field measures installed. I called Mercedes’ myself and they ordered parts. Pays to make a call yourself

  9. Amy C. says:

Has anyone gotten their check yet? I had mine done in April of 2021, filed a claim in June, 2021 and STILL don’t have a check.

    1. JOHN Sveistrup says:

Like you I am also waiting for a settlement check from MB Canada or their Agent… All relevant documentation was sent to JND Legal Admin., March 22, 2022. (Ref: Mercedes Benz GLK250)

      1. Eric Brassard says:

Same here we had the field measure installed at the beginning of March of 2022, and still no check. Also impossible to get through their line. Montreal, QC

        1. Claude Leblanc says:

No payment here either, field measure done in may 2022, i believe the settlement firm will wait until march 2023 to begin payments…meanwhile banking interest on settlement.

  10. Levi Frias says:

It is now March 8, 2022 and I am still waiting for info on the availability of the Field Measure system so I can get it installed by the MB dealer close to me. I still have not received your second letter as assured by your rep. I want this thing done before I go long driving. Please advise A.S.A.P.

    1. Leno Jey says:

My father booked 2 appointments at 2 different MB dealerships for the field measurement installation system. They told him that they didn’t have the parts to do the service. I don’t know if they are lying or if they are really of out parts.

    2. joe says:

I am in the same predicament, could they be stalling?
