A $350,000 settlement has been reached benefiting those who were affected by a Netlink Computer Inc. (NCIX) data breach.

The Class includes all former employees and customers of Netlink Computer Inc., doing business as NCIX.

The plaintiff in a 2018 class action lawsuit had alleged breaches of privacy that affected NCIX customers and employees as the company was being dissolved.

The defendants have denied all allegations of wrongdoing, and the Court has not ruled in favor of either party.

A British Columbia judge approved the settlement Feb. 5, 2021.

Class Members may make a claim for a substantiated loss that was directly caused by the NCIX data breach.

Losses covered by the NCIX settlement include, but are not limited to, unauthorized bank or credit card charges, credit monitoring or insurance, unauthorized lending, and credit reports.

When filing a claim for a substantiated loss, the Class Member must provide reliable and credible evidence of the loss, such as credit card statements, invoices, receipts for out-of-pocket expenses, and fraud reports.

Class Members filing a claim for a substantiated loss may also be eligible for reimbursement for two hours of lost time, at a rate of $20 per hour, for each category of approved substantiated loss.

Lost-time claims cannot be filed without an associated and approved claim for substantiated loss.

In addition, each claim must include proof of Class membership, such as a redacted T4 or other proof of employment with NCIX for employees or redacted proof of purchase for customers.

All personal information other than the claimant’s full name should be redacted.

Class Members may not make a claim for any amounts that have been previously reimbursed from another source.

Each claim must include the following:

  • Full name
  • Contact information (mailing address, email, phone number)
  • Proof of substantiated loss
  • Confirmation that the substantiated loss has not been reimbursed from another source
  • Proof of Class membership
  • Date and signature
