Several automakers have been hit with a class action lawsuit alleging certain Honda and Toyota vehicles had a fuel pump defect that can cause serious engine problems that can increase the likelihood of an automobile accident and the potential of bodily injury or harm to the vehicle occupants.

Plaintiff Vikram Singh Atwal of Surrey, British Columbia, says he leased a new 2018 Acura MDX from an authorized Honda Acura dealership after interacting with a sales representative who failed to disclose the vehicle had a defective fuel pump.

Vikram says he decided to lease the Acura MDX primarily because of Honda’s “pervasive marketing message of safety and dependability.”

However, he says he did not get the benefit of the bargain he expected. According to the defective fuel pump class action lawsuit, Vikram “leased a vehicle of lesser standard, grade, and quality than represented, and did not receive a vehicle that met ordinary and reasonable consumer expectations regarding safe and dependable operation.”

Denso Corporation, Denso International America Inc., Honda Motor Company Ltd., Honda of America Mfg Inc., Toyota Motor Corporation, Toyota Motor Manufacturing Canada Inc., Toyota Motor Engineering & Manufacturing North America Inc, Toyota Motor Manufacturing Kentucky Inc., Toyota Motor Manufacturing Indiana Inc., Toyota Motor Manufacturing Mississippi Inc., and Toyota Motor Manufacturing Texas Inc. are all named as defendants in the fuel pump defect class action lawsuit.

According to the defective fuel pump class action lawsuit, the Denso defendants reportedly submitted a Part 573 Safety Recall Report on April 27 to the U.S. National Highway Traffic Safety Administration (NHTSA), voluntarily recalling more than 2 million fuel pumps that the company had supplied to the Honda and Toyota defendants.

The recalled fuel pump was reportedly low-pressure and could cause affected vehicles to stall unexpectedly, lose engine power and/or shut down while the vehicle is in operation.

The allegedly defective fuel pumps had an impeller that could become deformed under certain conditions, rendering the fuel pump inoperable. Denso reportedly acknowledged that the fuel pump defect could cause rough engine running, engines that fail to start, and engines that stall at low speeds. The fuel pump defect could allegedly increase the risk of an automobile accident while driving.

“The Fuel Pump Defect in the Affected Class Vehicles exposes vehicle occupants and others to extreme danger,” the defective fuel pump class action lawsuit alleges. “A vehicle that stalls, loses engine power and/or suffers engine shutdown is at heightened risk for collision because it exposes drivers to react to remove themselves from danger, typically by exiting or attempting to exit the road.”

According to the defective fuel pump lawsuit, the Honda defendants should have known that the Denso fuel pump in some of its vehicles was defective because the Honda defendants recalled more than 400,000 vehicles in January 2019 due to low-pressure fuel pumps made by Denso.

Similarly, the Toyota defendants voluntarily recalled more than 695,000 Toyota and Lexus vehicles due to the defective fuel pump in January 2020. This statistic reportedly includes more than 46,000 vehicles in Canada.

“Both the Honda Recall and Toyota Recall were and are inadequate as they failed to accurately diagnose and remedy the Fuel Pump Defect, failed to include all Honda and Toyota vehicles equipped with the Denso low-pressure fuel pump and failed to recommend that owners and/or lessees stop driving their vehicles until they are repaired or fixed,” the defective fuel pump class action lawsuit states.

Vikram filed the fuel pump defect class action lawsuit on behalf of himself and a proposed Class of Canadian residents (excluding those who reside in Quebec) who own, owned, lease and/or leased one of the vehicles listed above.

    I received recall for 2019 CRV fuel pump but dealer and Honda Canada doesn’t know when the fuel pump will be available. I won’t drive the vehicle until it’s fixed.

    I bought a 2020 corolla in January 2020. I was not informed of the recall in my car and still have not been informed even though it’s in the shop again (I believe for the 7th time this year) due to problems. So in less than a year and half, with only 18,000km (not miles) I’ve been without a vehicle multiple times. I’m only offered a rental when repairs are longer than 48 hours which means I have no means of transportation.

    I’m having the issue with my engine and told them about it stalling out, including on an on ramp for the highway. I was told my engine sounded normal. I was brushed off time and time again about the sounds it was making and it stalling out, along with “ignition off’ warning signs and “power steering low” while driving despite the engine sometimes still running. These are serious issues that could have caused multiple accidents for me. There was also a defective air conditioning unit that took over 2 weeks to repair.

    So in 1.5 years of owning my brand new 2020 corolla I’ve been with a rental vehicle twice for extended repairs.

    I wish I never bought this vehicle. What an absolute disgrace of a company. They’ve known about this recall since the day I bought my car and brushed it off and allowed me to drive and put myself in danger. I was treated like I knew nothing because I’m a woman despite informing them that I’ve done all of the maintenance on my own cars prior to buying with Toyota and the sound coming from my engine normal and the periodic stalling while driving “could not be replicated”.

    I will happily provide all documentation and information if it helps progress this lawsuit.

    I had my fuel pump replaced in my 2019 Honda Civic on August 20,2020 since it was on recall. August 22nd , TWO DAYS after I had a brand new fuel pump installed, my car died while I was driving 125 km/hr on a Highway near Halifax NS. I luckily avoided an accident. Honda refused to tow my vehicle to my desired location (83km away) and refused to cover my taxi fair over the phone with roadside assistance. I later learned on their website that they offer both of these with my extended warranty and I have been waiting to hear back from Honda on any reimbursement for a week now.
