Courts in Ontario, British Columbia and Quebec have approved approximately $25.6 million in settlements in the Automotive Wire Harness Systems price-fixing class action.

If you purchased or leased a new Honda, Acura, Nissan, Infiniti, Toyota, Lexus, Subaru and/or Pontiac Vibe between Jan. 1, 1999 and Nov. 30, 2014 you are eligible to file a claim for the auto parts price-fixing class action settlement and may potentially receive compensation.

According to the auto parts price-fixing class action lawsuit, manufacturers of automotive wire harness systems engaged in a price-fixing scheme that caused consumers to pay too much for the automotive wire harness systems and vehicles with the auto wire harness systems installed.

An automotive wire harness system distributes electricity to electronic components, circuit boards and wiring.

The amount each Class Member will receive depends on several factors, including the vehicle’s purchase price, when the vehicle was purchased and whether the Class Member is classified as an end user, dealer or national brand importer.

When filing a claim, Class Members may be required to provide purchase records for the affected vehicle(s). In some cases, purchases may be established on sales records provided by the automotive dealerships. 

Class Members whose claims are approved are expected to receive a payment of at least $25.

“The plan represents an opportunity for consumers and businesses to recover overpayments on millions of vehicles sold in Canada,” Charles Wright, a partner at Siskinds LLP, said about the Automotive Wire Harness Systems price-fixing class action settlement.

The settling defendants do not admit any wrongdoing.

It is important to note that no wrongdoing has been alleged against General Motors, Honda, Nissan, Subaru and Toyota. The motor companies were reportedly unaware that automotive wire harness systems they purchased to install in their vehicles were part of a price-fixing scheme.

Auto parts manufacturers have been investigated globally over the price-fixing conspiracy, which is considered the largest antitrust investigation in history in terms of the number of parts affected, the number of parties involved, and the fines that have been imposed.

There are more than three dozen auto parts price-fixing class action lawsuits that are still in process in Canada, and other auto parts class action settlements may follow. Settlements have been reached in six other cases, and funds from those settlements will be distributed with funds from the automotive wire harness system distribution.

It is likely that some vehicles that are covered by this automotive wire harness settlement will also be covered by other settlements in the auto parts price-fixing litigation. If you qualify as a Class Member of the automotive wire harness system settlement, you may need to submit a claim in order to maintain eligibility to participate in future auto parts price-fixing settlements.

The deadline to file a claim is June 12, 2020.

    I just leased a 2021 Toyota Rav 4 Hybrid. I have driven it less than 4000KM. We are only in the middle of April 2021 and I had to take it in for a Hybrid malfunction. The dealer advised that rodents had chewed through some wires and it is not covered under warranty so I need to contact my insurance company, I would have to pay a $500 deductible. I have just found out that Toyota is using soy based wiring and it is obviously tasty to rodents. There have been class action lawsuits against them for this. I am annoyed this was not communicated when I decided to lease the car, obviously such a feature would have factored into my choice.. I believe Toyota should be covering the cost of repair as well as the cost of spraying with a rodent deterrent such as NH oil undercoating.

    I have a 96 Buick and all electrical is mess up from the beginning.. This is because the vehicle has a solid tail light wire strip.. in other words the tail light goes all the way across which is the first for automobile.. For all that my windows nor locks work at all.. once a month I have to re wire nut the hot cable from battery.. it burns apart .. I’m just figuring it will catch fire before to Long and can’t believe hasn’t yet.. where’s the recall on this or does it take someone to die first???? 1996 Buick century custom…
