Tylenol medicine in different packaging regarding the class action lawsuit moving forward in QuebecA Quebec Superior Court judge will allow a $10 million class action lawsuit involving allegedly undisclosed Tylenol side effects to move forward.

Plaintiff Kathleen Gauthier alleges Johnson & Johnson failed to disclose consumers about potential Tylenol side effects such as the risk of death and the risk of liver damage requiring a liver transplant.

Tylenol (acetaminophen) is a pain reliever made by Johnson & Johnson. It can be used to relieve mild to moderate pain associated with headaches, muscle aches, toothaches, back aches and fevers.

Gauthier asserts that Johnson & Johnson breached its duties under the Consumer Protection Act by failing to disclose and warn about the risk of dangerous side effects.

According to the Tylenol class action lawsuit, Gauthier would not have used Tylenol as frequently and she would not have given the painkiller to her children if she had known of these serious risks.

In the Tylenol class action lawsuit, Gauthier does not allege that she or her children suffered from any health issues from taking Tylenol. However, she claims that Johnson & Johnson concealed the dangerous risks from the public in order to protect its market share in Canada. She says she learned about the risks in 2017.

Johnson & Johnson included the risk of death and serious liver damage on Tylenol products and reduced the daily maximum dosage in the United States but did not take these steps to protect consumers in Canada, according to the Tylenol side effects class action lawsuit.

Class Members of the Tylenol side effects lawsuit include Quebec residents who purchased certain Tylenol products between October 2015 and December 2017. The Tylenol class action lawsuit lists 19 Tylenol products for adults and 12 Tylenol products for children. These products include:

  • Tylenol Complete Cold, Cough & Flu Plus Mucus Relief Syrup
  • Tylenol Complete Cold, Cough & Flu Plus Mucus Relief Nighttime Syrup
  • Tylenol Cold
  • Tylenol Cough
  • Tylenol Flu
  • Tylenol Cold & Sinus
  • Tylenol Sinus Infants and Children
  • Infants’ Tylenol Drops
  • Infants’ Tylenol Fever & Sore Throat Pain

The Tylenol class action lawsuit seeks $10 million in damages and $100 in punitive damages for each Class Member.

    I would like to be added to this Class action. It is about time that something is being done. When I was in getting my transplant all the nurses knew that it was possible to need a transplant due to Tylenol and there were three people on my floor who were there getting a liver transplant because of it.
