British Airways, Air Canada Air Freight Price-Fixing Class Action Settlement Overview: 

  • Who: British Airways and Air Canada have been given the green light to distribute $16 million more in settlement funds. 
  • Why: The airlines agreed to the settlement, now worth around $45 million, to resolve claims they were involved in a global price-fixing conspiracy for air freight shipping.
  • Where: The airlines were given the OK to distribute the settlement funds by courts in Quebec and British Columbia.

British Airways and Air Canada will distribute $16 million more in settlement funds after the airlines agreed to settle claims they engaged in price-fixing for air cargo. 

The $16 million, which was approved for distribution by courts in British Columbia and Quebec, is in addition to $29.6 million which has already been distributed, according to a news release.

British Airways and Air Canada agreed to the settlement to resolve claims they were involved in a global conspiracy to fix the prices for air freight shipping. 

The airlines have not admitted any wrongdoing or liability in agreeing to the settlement. 

Consumers eligible to benefit from the settlement are those who purchased air freight shipping services for items sent to or from Canada between January 2000 and September 2006. 

Air Freight Consumers With Shipments Sent to or From U.S. Excluded

Individuals who had shipments sent to or from the United States are excluded from being eligible to benefit from the settlement. 

Potential class members must submit a valid claim form online by July 4 to qualify for the latest settlement round.

Air Canada agreed to a separate settlement worth $4.5 million in November that resolved claims the airline had failed to properly refund customers whose flights to the United States were canceled during the COVID-19 pandemic. 

The airline will pay $2 million to the federal government and $2.5 million to customers demanding refunds, as per the settlement agreement. 

The claims were brought against Air Canada by the U.S. Department of Transportation, which argued the airline had failed to provide refunds to passengers who had flights canceled that were going to the United States.
