PornHub Class Action Lawsuit Overview:

  • Who: An Ontario resident filed a class action lawsuit against MindGeek, the parent company of PornHub.
  • Why: The plaintiff alleges that sexual videos of her were posted to PornHub without her consent. 
  • Where: The class action lawsuit seeks to represent any affected Canadians.

MindGeek, the parent company of PornHub, faces a $500 million class action lawsuit for allegedly allowing sexual videos to be uploaded to the pornography site without the consent of some participants. 

The plaintiff, Christine Wing, is an Ontario resident who alleges three videos of her were featured on PornHub in May 2020 without her consent. Wing seeks to include “any or all individuals in Canada who appeared in sexual content disseminated by [MindGeek], including intimate videos or images” as plaintiffs in the class action lawsuit.

“What does one have when you’ve lost your privacy in the worst way?” Wing said in a news release. “This is a violation of the most egregious kind.”

The $500 million excludes additional punitive or aggravated damages. 

PornHub Policies Fail Victims, Class Action Lawsuit Says

PornHub introduced new policies in December 2020 to better pull unverified sexual content from the website. But Darryl Singer, head of commercial and civil litigation at Diamond and Diamond, which represents Wing, says those safeguards are “too little, too late.” 

“They definitely had a system in place,” Singer said. “Our position is they weren’t using the system. In other words, they paid lip service to it.”

MindGeek was the subject of a similar high-profile $600 million class action lawsuit in 2021 brought forward by Jane Doe, who claimed PornHub allowed videos of her previous sexual exploitation and non-consensual sexual content as a child to remain on the website.

Doe was only alerted to the sexual content of her on PornHub when a high school friend messaged her on social media, according to court documents.
