Turcot Interchange construction target of class action lawsuit

After three years of legal disputes, the Turcot Interchange class action lawsuit Canada finally reached a settlement. If you lived near Saint-Jacques Street in the Borough of Notre-Dame-de-Grâce or the east perimeter of Décarie Boulevard in Montreal any time since March 21, 2015, you may be entitled to potential compensation from the proposed Turcot Interchange class action lawsuit settlement.

Turcot Interchange Class Action Finally Reaches a Settlement

The Turcot Interchange class action lawsuit Canada, commenced in 2017, was finally settled in August, between lead plaintiffs, Frank Berdah, Giovanni Paquin and a corporation, and the Attorney General of Québec and other parties involved in the construction of the Turcot Interchange project. The Canada settlement is currently awaiting court approval. The approval hearing is scheduled for Oct. 15, 2020, at Montreal’s Palais de Justice.

The Ministère des Transports du Québec denies any wrongdoing, but has agreed to settle the Turcot Interchange class action lawsuit.

The three plaintiffs allege that the Ministère des Transports du Québec acted negligently and violated their rights to peaceful enjoyment of their property during the Turcot Interchange construction project. The noise and pollution caused by the construction have ostensibly caused the plaintiffs and Class Members “abnormal and intolerable inconveniences.”

According to Frank, one of the lead plaintiffs in the Turcot Interchange class action lawsuit, business has dropped at his upholstery family business on St-Jacques Street by as much as 60% since the construction of the new Turcot Interchange started.

“All the pounding, the machines, the pylons on the street…we have lost at least 50 to 60% of our business,” Frank told CBC reporters.

“They need to walk 300 to 400 metres just to get to the storefront,” he continued, adding that since most of his clients have to drop off or pick up furniture, many have stopped coming to his store altogether.

Destruction and Construction at the Turcot Interchange

The Turcot Interchange is located on the Island of Montreal, southwest of Montreal’s downtown core, which interconnects Highways 15, 20 and 720. The Turcot Interchange class action lawsuit calls the project “an essential road link between Montreal’s downtown area and the Champlain Bridge on its east side, and the Montreal-Pierre Elliott Trudeau International Airport on its west side.”

The construction project began in 2009. It is no surprise that residents and shop owners located near the construction site have been complaining: The project is “a massive undertaking which includes the demolition and reconstruction of other interchanges,” as well as roads, notes the Turcot Interchange class action lawsuit Canada.

Couple covering their ears regarding the Turcot Interchange class action lawsuit settlement In fact, noise complaints have gotten so bad over the years that CBC reported on Canadian psychologists who warned that exposure to major, long-term construction projects, like the Turcot Interchange project, could lead to depression and anxiety in certain people.

The years of work on the largest road construction project in Quebec history has managed to leave some destruction along its path. Many people living near the Turcot Interchange construction zone in Montreal’s St-Henri neighbourhood have been complaining about loud noise coming from the site 24 hours a day, seven days a week, not to mention the business interruptions affecting the area’s shops.

Class Members included in the proposed Turcot Interchange class action settlement are all residents, “who at any time since March 21, 2015, resided within 350 meters of that section of the Saint-Jacques Street, (including the Saint-Jacques overpass), which runs West to East, intersecting the West perimeter of Girouard Avenue in the City of Montreal, Borough of Notre-Dame-de-Grâce, and the East perimeter of Décarie Boulevard in the same Borough.”

Eligible Class Members are entitled to claim the following amounts, subject to Court approval:

  • $85.00 per month for 2016, per eligible claim
  • $55.00 per month for 2017, per eligible claim

In order to claim the above compensation, Class Members must have resided, any time in 2016 and 2017, at one of the following addresses:

  • Even addresses from 906 to 972 inclusively on Addington Avenue
  • Odd addresses from 901 to 923 inclusively on Girouard Avenue
  • Odd addresses from 5451 to 5493 inclusively on St-Jacques Street

If you do not wish to be legally bound by the settlement, you must exclude yourself by Oct. 12, 2020. If you do not opt out of the settlement, you will not be permitted to commence an individual Turcot Interchange lawsuit.
