McDonald’s Restaurants of Canada faces a lawsuit from a Vernon woman who claims she was badly injured from hot McDonald’s coffee from a cup with a lid that was not closed properly.

Plaintiff Inna Turchin filed a notice of claim against McDonald’s on January 17, seeing a total of $9,856 for her injuries, lost wages, medical expenses and other losses.

According to the McDonald’s coffee lawsuit, Turchin ordered a small latte at a McDonalds restaurant in November 2019. She claims the lid was not closed properly so that when she attempted to sip the beverage, hot liquid spilled on her body, burning her skin and ruining her clothes. 

According to iNFOnews.ca, she subsequently sought treatment at the Vernon Jubilee Hospital emergency room. She was diagnosed with burns to her breasts and abdomen, according to the McDonald’s coffee lawsuit.

The doctor reportedly told her to take several days off from work, apply ointment to the affected area and take painkillers as needed.

“I had blisters on my breasts and abdomen which turned into seeping wounds,” Turchin alleges in her McDonald’s coffee lawsuit. She says the injury made it difficult to sleep and “limited her ability to function and concentrate on the job, do activities or exercise enough.”

In addition, Turchin fears that the scars left from the burns, which are darker than her natural skin tone, will be permanent.

The McDonald’s hot coffee lawsuit blames the incident on an employee’s negligence for failing to put the lid on the coffee cup properly. Turchin does not name the McDonald’s employee.

According to the court documents, a supervisor at the McDonald’s restaurant addressed and documented the incident.

Turchin filed the McDonald’s hot coffee lawsuit in small claims court. She seeks $8,000 for pain and suffering, $1,250 for lost wages, $50 for medical expenses and $380 to reimburse her for the cost of the handmade alpaca cardigan she was wearing when the coffee spilled on her.

In 1992, a 79-year-old American named Stella Liebeck famously sued McDonald’s after she spilled hot coffee on herself and suffered third-degree burns. The burns were so severe that she required skin grafts and two years of treatment. She sought to settle the case for $20,000 but McDonald’s refused.

At trial, a jury awarded Liebeck $160,000 in compensatory damages for her pain, suffering and medical expenses.

The jury also awarded Liebeck $2.7 million in punitive damages, although she reportedly reached a settlement with McDonald’s for an undisclosed amount to prevent the possibility of appeals.

    I was looking for a way to heal a coffee burn when I came across this post!!
    This is what happened to me tonight: the McDonald’s employee did not correctly close the XL coffee lid, and as soon as I grabbed the coffee and brought it back into my car, the lid popped up, the coffee dripped on my hand and my entire right leg. My immediate reaction was to let go of the brake because I felt a severe burning sensation on my leg, and my car began to move forward.
    I hit the brakes while still holding the hot coffee to ensure I didn’t hit the car in front of me and then threw the coffee cup out the window. I got out of my car and started jumping up and down to cool down. Because there was so much coffee dripping from everywhere, my friend began cleaning my seat and everything around it. They gave me some ice and some burning creams, and the manager inquired about what had occurred and requested my name and phone number for reasons I do not understand.
    I got home, and unfortunately, I felt the burn on my leg, and my car got washed with coffee. I am heartbroken because I have been going to this location for 25 years, and most of the night shift employees know me. It is tough for me to detail my car myself as it is a sport with leather seats. And since it’s a small car, it is tough to get in between the seats and get the coffee stain out.
    I’m relieved that I didn’t hit the car in front of me in the drive-thru.
    I told the manager everything was fine and that I had no complaints about the employee who served the coffee because they were always pleasant to me. However, I didn’t want her to be out of a job.
    However, nothing was fine, especially when I got home and saw the result. I’m afraid I’ll have to ask any employee to double-check the coffee lid before passing it to me or start making coffee at home from now on.
    I hope that from now on, they will pay more attention before passing a hot coffee to someone in the car; it’s not like you can throw it out the window, especially while holding it with your right hand and the coffee is already midway inside the car. One mistake resulted in a burned leg and a sticky car. Because of my burnt leg, I can’t even go to my laser appointment 🙁

    Its not the lids is the freaking boiling temperature. Once I bought a really hot coffee not McDonalds, I realized it was dangerous because a little poured on my hand. Besides it was full to the brim.

    From that day I prepare coffee at home and allow for it to cool down before serving.

    Besides is cheaper that way

      I had the same thing happen
      I have pictures of the coffee down my arm and leg.
      I contacted McDonald’s head office 3 times
      each time they said they would have a supervisor call me back. They never do. How can l get help for this?

        I went threw the drive thru and ordered 4 cheese burgers and one burger wasn’t even cooked,day and half later I was in the hospital vomitting and explosive Diarra!!

    I am shocked that a grown adult orders a hot drink, or any drink for that matter, and does not check to make sire the lids are on properly. Fast food workers are trying to fill orders as fast as they can to keep customers from wining and complaining about the service. This makes them bad at putting lids on drinks.
    FOR PETE’S SAKE PEOPLE: ACT LIKE AN ADULT AND CHECK YOUR LIDS!

      I’m sorry but I worked at McDonald’s n if it’s in a drive thru you have plenty of time to make sure those kids on properly .. so dont feed people that bullsh t. This falls on to the worker n McDonald’s…. here you go and these kids wants 15hr they are not even worth 5.25hr ( very sloppy people ..
