capital one bankA Capital One class action claims that the company’s recent data breach affected millions of Canadians, entitling them to compensation.

Plaintiffs Brian Hennings and Raylene Yurkewich say they were affected by the 2019 Capital One data breach, which caused their personal information to be compromised.

Capital One reportedly became aware of the data breach in mid July 2019. By July 19, the company allegedly confirmed that 106 million of their customers had their personal information compromised when a third party accessed the data in March 2019.

By July 29, Capital One revealed that 6 million Canadians had been affected by the data breach.

The Capital One data breach allegedly occurred due to a misconfigured firewall. The cybersecurity failure reportedly allowed hackers to access Capital One’s cloud repository where they accessed customer information.

According to the Canadian Capital One class action, a variety of information from consumers who applied for a Capital One credit card between 2005 and 2019 was compromised in the breach.

Hackers reportedly got a hold of names, mailing addresses, phone numbers, dates of birth, credit history, Social Security numbers or Social Insurance Numbers, bank account numbers, email address, employment status, annual income, household income, monthly rent, and other financial information.

Rather than Social Security numbers, Canadian consumers reportedly had their Social Insurance Numbers compromised. These numbers are required to work in Canada and are as essential to Canadian residents as Social Security numbers are to Americans.

“Regardless of whether an individual is able to get a replacement SIN number, it will have significant impact on them as they will have to notify all financial institutions that they deal with and they could still be liable for debts created from an imposter using their old SIN card,” the Canadian Capital One class action lawsuit states.

Hennings and Yurkewich claim that they are among the millions of Canadian consumers who had their data stolen in the Capital One data breach.

They say that they will suffer from a variety of damages, including the need for credit monitoring and identity theft insurance, anxiety about potential fraud, and the potential injury of identity theft, credit card fraud, and other types of fraudulent behavior they may fall victim to.

The plaintiffs in the Capital One class action seek to represent a Class of Canadian individuals who had their personal information compromised by the Capital One data breach.

They also seek to represent a Family Class of people who are entitled to make claims as a result of the data breach by reason of their familial relationship with a Class Member.
