Shangri-La condo tower class action settlement overview: 

  • Who: Condo owners who purchased units at Vancouver’s Shangri-La residential tower prior to its construction are set to receive $6.64 million in a proposed class action settlement. 
  • Why: The class action settlement was made to resolve claims the residential condo tower was constructed with windows containing cracking, shattering, and fogging defects.

A $6.64 million class action settlement has been reached that would resolve claims Vancouver’s Shangri-La residential condo tower was built with windows containing cracking, shattering, and fogging defects. 

The settlement — which still needs to be approved by the B.C. Supreme Court — was made to compensate individuals who were original and early presale buyers for condos in the Shangri-La tower, reports the Vancouver Sun

Current condo owners at Shangri-La tower will reportedly not be covered by the proposed class action settlement in the event they purchased their units after construction, which began in 2015 and was finished in 2019. 

If approved, the settlement will include cash payments for condo owners that will be calculated by the size of their condo units and are estimated to range from around $8,870 to more than $87,000 in total compensation, reports the Vancouver Sun. 

Condo owners covered by the class action settlement, in exchange for the compensation, will reportedly be giving up their right to file a lawsuit over any financial and property loss including a loss of rental income or drop in market value.

Owners would also give up their right to sue over costs incurred repairing both individual units and common property, reports the Vancouver Sun.

The class action settlement was reportedly revealed last month and will allow two pending legal actions against the legal owner of the land the Shangri-La tower is built on and its developer and partners to proceed, with a hearing set for April 24. 

The defendants include KBK No. 11 Ventures Ltd., its developer 1100 Georgia Partnership and its partners, including Peterson Bank and Westbank Corp., among others, reports the Vancouver Sun. 

In another case involving Vancouver, mining company Teck Metals was ordered to pay $2.2 million by the Provincial Court of British Columbia after the company pleaded guilty to violating several laws by releasing effluent into the Columbia river in 2019.
