Canadian National Railway Vaccine Mandate Proposed Class Action Overview:

  • Who: Canadian National Railway employees have sent a cease-and-desist letter to their employer.
  • Why: The employees oppose the railway’s mandate that all workers should be fully vaccinated by Nov. 15.
  • Where: The anonymous workers seek to represent Canadian National employees nationwide.

Canadian National Railway workers are hitting back against the company’s vaccine mandate, sending their employer a letter threatening class action if it persists with the recently announced policy.

In September, Canadian National Railway announced its decision that all 25,000 of its employees must be fully vaccinated by Nov. 15 to continue working for the company.

As a result, a group of railway workers have retained counsel and sent a cease-and-desist letter to the national rail carrier, Moosejaw Today reports.

“We represent a class of employees whose employment is threatened by suspension without pay with the possibility of termination by CN’s announcement that it intends to make double COVID-19 vaccination a bona fide occupational requirement, effective 1 November 2021,” the letter reads.

“A list of the members of this class is attached. We are instructed to take the position that they all face wrongful dismissal.”

Canadian National Railway Workers Want Vaccine Mandate Alternatives

The employees argue that there are “many practical alternatives” to mandatory vaccination that would be “more effective” at controlling spread of the virus at the rail carrier. 

They say all of the alternatives are far less prejudicial than “summary termination of loyal employees exercising their human right and civil liberty to refuse the vaccine.” 

None of those proposed alternatives are listed in the letter.

The employees also argue that “there is no scientific data to support the conclusion that the Covid-19 vaccines have had any impact upon reducing the spread of the virus.”

The letter adds that if the mandate goes forward, the employees will launch a class action lawsuit against their employer as well as filing multiple human rights claims and seeking damages.

The news comes after a group of ombudsmen from across Canada in May warned premiers and other officials of the legal risks associated with requiring people to show vaccine passports, or other proof of vaccination, to access services. 

Last year, Vaccine Choice Canada filed a 190-page lawsuit challenging the Canadian government’s response to the COVID-19 pandemic

    Shame on CN C P railway. Who will replace these qualified workers they are all essential workers and very important to make sure the public are safe at all rail crossing and make things get to the companies move all material across Canada from port to port

    If the big guys whoever is behind the vaccination part if they would just stop the virus would be over there is no reason to have vaccination of covid-19 either way it spreads so what’s the difference well the difference is the vaccinated people are at higher risk then the non-vaccinated people.

    I stand with the railway workers. This was not perfect of their hiring contract. Just because you have the shot doesn’t mean you can’t spread the virus. Discriminating due to medical choice is plain and simple wrong! Plus, why are they discounting natural immunity which is already being shown to be 13x greater then two shots.

    Not a Union person but I stand with the Railway Workers. It’s a sad day for Canada and Democracy when the “opinions” of a few paranoid Doctors can supersede the Charter of Rights and Freedoms.

    I stand with the railway workers. I wish that every other union and or businesses would stand up and do the same. It’s unconstitutional. It’s blatantly obvious that there’s another malicious reason behind these mandates

    The vaccine mandates are unconstitutional. CP Rail is too have a vaccination policy in place Oct.30, 2021.
    Several CP Rail employees are opposed to the vaccination mandate & will be filing a class action lawsuit if the only option to retain employment is vaccination.
