Northwood COVID-19 Class Action Lawsuit Overview:

Nova Scotia has been added as a defendant in a proposed class action lawsuit filed after more than 50 residents of the Northwood long-term care facility died during the first wave of the COVID-19 pandemic.

The Northwood class action lawsuit was initially filed in June 2020 and argued that the long-term care facility’s policies and practices allowed COVID-19 to spread, causing the death of 53 residents.

Last week, lawyers representing the proposed class filed amendments to add Nova Scotia as a defendant, arguing that the province’s budget cuts and freezes in the long-care sector created a situation that left residents vulnerable to infectious diseases.

The proposed Northwood class action lawsuit also claims that Nova Scotia failed to provide adequate regulation and oversight at the long-term facility. 

“The province took decisive action in Nova Scotia’s hospitals while choosing not to take or mandate these similar precautions in long-term care facilities to prevent and limit the fatal outbreak,” Wagners Law Firm said in a news release. “The province’s choices and inaction led to the deaths of many vulnerable citizens entrusted to their care and oversight.”

Lawyer Ray Wagner of Wagners Law Firm says that this proposed Northwood class action lawsuit could provide insight about the long-term care facility’s response to the pandemic.

“Class members still don’t have answers about the chaotic outbreak, acknowledgements that actionable steps will be taken to prevent such a tragedy in the future or even an apology,” Wagner said in a statement. “These remedies are, to some, just as important as compensation for the loss of their loved ones sought by the action.”

The Northwood COVID-19 lawsuit has not yet been certified as a class action lawsuit.
