TD Insurance has agreed to pay a total of $5.1 million to resolve claims it wrongly denied trip cancellation claims related to COVID-19.
A Toronto man accused TD Insurance of rejecting many trip cancellation claims during the COVID-19 pandemic, due to the majority of airlines offering credits or vouchers for cancelled trips, reports the Toronto Star.
The Toronto man—who had booked a flight for a family cruise in Italy—reportedly argued, however, that having a trip cancellation claim rejected on account of a credit or voucher offer had not appeared in TD Insurance’s travel cancellation policies.
The settlement agreement was reached following mediation and will have TD Insurance pay a total of $5.1 million—including $300,000 in costs — reports the Toronto Star.
The class action lawsuit was reportedly originally asking for $10 million in compensation. The settlement agreement will now go to a February court hearing to see if it will be formally approved.

In addition to the financial part of the settlement, TD Insurance has said it will compensate its customers who submitted a trip cancellation claim and were either fully or partially denied on account of receiving a trip voucher, coupon, or credit from an airline, reports Insurance Business America.
Reimbursements will reportedly be offered to three specific groups, including travellers with a claim related to an amount paid and that was already reimbursed by an airline, and individuals who had not been received by an airline or received a voucher or credit for travel costs.
TD Insurance will also offer reimbursements to travellers who were reimbursed by an airline but not given a credit or voucher for another claim under TD Insurance’s policy, reports Insurance Business America.
A separate class action lawsuit was filed against TD Insurance in September by a consumer arguing the company broke the law by allegedly fraudulently opening accounts for people without consent.

I lived at this Hotel in Saskatoon and was Sexaul Assault every day and because I never put out he put my rent up plus he made me live with ice inside my door and wouldn’t give me another room kept me in the back where there was no cameras and gang members everyday hurrasing me . The owner would touch my private parts groping me and saying inappropriate things to me about how he would love to take his private part and slap me on my bum and then drive it up my Ass so hard that I would pass out. This went on for 4 to 5 years him knowing that I had no choice but to stay there. He ask me to go to his room but come in the back not the front he said so no one would see me go . The Hotel was Northwoods and the Owner Name John.
