Canadian National Railway Vaccine Mandate Proposed Class Action Overview:

  • Who: Canadian National Railway employees have sent a cease-and-desist letter to their employer.
  • Why: The employees oppose the railway’s mandate that all workers should be fully vaccinated by Nov. 15.
  • Where: The anonymous workers seek to represent Canadian National employees nationwide.

Canadian National Railway workers are hitting back against the company’s vaccine mandate, sending their employer a letter threatening class action if it persists with the recently announced policy.

In September, Canadian National Railway announced its decision that all 25,000 of its employees must be fully vaccinated by Nov. 15 to continue working for the company.

As a result, a group of railway workers have retained counsel and sent a cease-and-desist letter to the national rail carrier, Moosejaw Today reports.

“We represent a class of employees whose employment is threatened by suspension without pay with the possibility of termination by CN’s announcement that it intends to make double COVID-19 vaccination a bona fide occupational requirement, effective 1 November 2021,” the letter reads.

“A list of the members of this class is attached. We are instructed to take the position that they all face wrongful dismissal.”

Canadian National Railway Workers Want Vaccine Mandate Alternatives

The employees argue that there are “many practical alternatives” to mandatory vaccination that would be “more effective” at controlling spread of the virus at the rail carrier. 

They say all of the alternatives are far less prejudicial than “summary termination of loyal employees exercising their human right and civil liberty to refuse the vaccine.” 

None of those proposed alternatives are listed in the letter.

The employees also argue that “there is no scientific data to support the conclusion that the Covid-19 vaccines have had any impact upon reducing the spread of the virus.”

The letter adds that if the mandate goes forward, the employees will launch a class action lawsuit against their employer as well as filing multiple human rights claims and seeking damages.

The news comes after a group of ombudsmen from across Canada in May warned premiers and other officials of the legal risks associated with requiring people to show vaccine passports, or other proof of vaccination, to access services. 

Last year, Vaccine Choice Canada filed a 190-page lawsuit challenging the Canadian government’s response to the COVID-19 pandemic

    I work for a branch of CN. Transx group of cie. I am currently on maternity leave so everything that happened in November for all the unvaccinated did not affect me at the moment as my employee status was not active. I am now pregnant again, set to go back in June but still not vaccinated.
    My employer just explained to me that even if the federal mandate are dropped I will be losing my job in June as I am not vaccinated nobody will hire a pregnant women, so I am basically left in the dust, anxiety trough the roof. Is there anything I can do?

    It continues to baffle me that the government people making these mandates keep overlooking the fact that there are no long term studies on these “vaccines” and that they still don’t even have full FDA approval. We’re continually told that the entire medical community agrees with the mandates but the reality is that those in the medical community who disagree with the mandates are instantly threatened with the loss of their medical license and of course censored. Any government official who dares to say that the unvaccinated aren’t devils is instantly forced to retract their statement. I don’t understand why more people don’t see this as a serious problem.

    I feel sorry for the doctors , lawyers, union reps. and politicians that have sold their soles for this poison. Hope you can live with yourselves and keep looking in a mirror.

      It funny that the government can continue to use unvaccinated population as a scapegoat. That fact is it was vaccinated passenger under condition of the vaccine passport who transmitted and brought the new Omicron variant in to Canada and that why hospital are over whelmed. People were led to believe that they were safe .vaccination definition means immunity and you don’t get immunity. Molecular biology Christina Park has stated in fact, replication of coronavirus have been found to persist in the mucosa of the nasopharynx of vaccinated people and they will continue to transmit COVID . And to suggest that the Africa is the problem is racist as France has a new variant and not travel bans for the French. Also to say everyone in Canada has to be vaccinated and as the broader for US residents will be with unvaccinated population and then allowed to come in to Canada. It Really is discrimination.

    I stand with railway workers.. when a person has health issues from the vaccine its stated they have underlying issues. The many I know have issues, I know of 3 people who died within a week of injection. Three with heart conditions. One liver condition and an unknown virus.. it’s experimental, even the guy that designed the mrna technology said they have no idea of the outcome. It’s in human trial right now was his statement.

      God bless you for coming forward with this news. I work for CP Rail and have a grave heart condition. I have been terminated with cause for not risking taking the vaccine. More than 25 years with company and over 60 perhaps a stance they take to eliminate having to pay out severances. Keep fighting…..

    Really, you need to get a tetanus vaccine to work, some work places also include hep c and others. Companies have an obligation to provide a safe work place, hence why you need steel toed boots. You have a choice get the shot or find a new job, there seem to lots of places that are hiring those that wear a tinfoil hat.

      Perhaps, you should grow a brain. It’s common knowledge by now that the vaccines do not prevent catching or spreading the virus. Look at Gibraltar and Ireland and other countries with high rates of vaccination (even triple doses). The mandates make no sense at all, especially given that the vaccines “reduces the chances of hospitalization and severe outcome” for the person that has taken it. So why do you need the person next to you vaccinated?

      Tetanus is NOT an experimental shot in a clinical trial. It has been proven to work NOT cause life-long consequences. Steel toed boots can be removed after work. I saw a portable seat belt people can wear when they are out walking – perhaps you should get yourself one for Christmas to be extra safe.

      Safe work place? Really? Safe from what exactly? If you have the ‘vaccine’ and still have to wear a mask, and still have to ‘follow orders’, how will you ever ‘be safe’ ? Are you safe when you walk out of your house?
