FCA Canada has been hit with a proposed class action lawsuit alleging certain Dodge Ram and Dodge Durango vehicles have a defect that can cause them to roll away even when the car is in park.

“This class action concerns the intentional, negligent, or dangerous design, manufacture, and installation of rotary gear shifters or components in the vehicles manufactured by the defendants, which resulted in numerous vehicles rolling away after being put into park and/or the vehicle being turned off,” the FCA Canada class action lawsuit states.

The FCA defendants named in the statement of claim are Fiat Chrysler Automobiles N.V., Fiat Chrysler Automobiles US LLC and Fiat Chrysler Automobiles Canada Inc.

Plaintiff: Dodge Ram Roll-Away Defect Caused Severe Injuries

Plaintiff Neil Erik Anthony Linton says his 2016 Dodge Ram 1500 rolled down a hill even though he had placed the vehicle into park, causing him to sustain serious injuries when he attempted to stop the vehicle.

According to the FCA Canada class action lawsuit, Linton and his children were on a camping trip in August 2018. He parked his truck with a trailer attached on level ground at the top of a hill and put the truck into park before he exited the vehicle.

“Suddenly, and without warning, the vehicle began to roll down the embankment with his two young children still in the vehicle,” the FCA Canada class action lawsuit states.

Linton says he attempted to get back into the vehicle and was able to steer the truck off the road.

“The truck only stopped as a result of the trailer jack digging into the ground,” Linton says. According to the FCA Canada class action lawsuit, Linton became stuck between the truck door and a tree. One of his children had to flag down a bystander for help.

Once an air ambulance arrived, Linton was extracted from the truck and transported to the hospital.

As a result of the Dodge Ram roll-away incident, Linton suffered more than a dozen personal injuries, including liver laceration, multiple rib fractures, soft tissue damage, internal bleeding of the kidney, traumatic brain injury, impaired motor skills and impaired motor function.

Linton says he has not been able to return to work since the incident due to the injuries he sustained. The truck was a total write-off due to the damage it incurred during the roll-away incident, according to the FCA class action lawsuit.

Class Action: Multiple Dodge Ram Roll-Away Complaints Reported

Red Dodge Durango in a showroom - fca canadaAfter the roll-away incident, Linton says he filed a complaint about the Dodge Ram 1500 to Transport Canada, which conducted an investigation.

Transport Canada reportedly found there had been multiple other complaints about Dodge Ram 1500 vehicles rolling away when in park.

“In these complaints the complainants reported that the transmission was in park and the ‘P’ symbol was illuminated when they entered their vehicles after the roll away incidents,” the FCA Canada class action lawsuit says.

Linton filed the FCA Canada class action lawsuit on behalf of himself and a proposed Class of Canadian residents who owned or leased a model year 2013-2016 Dodge Ram 1500 pickup truck or model year 2014-2016 Dodge Durango SUV equipped with an electronic transmission with a rotary control to select gear position.

Dodge Ram Defects Alleged in Other FCA Canada Class Action Lawsuits

FCA Canada is facing other Dodge Ram class action lawsuits alleging the trucks have potentially dangerous defects.

An FCA Canada class action lawsuit recently filed in Quebec alleges certain Dodge Ram trucks have an exhaust gas recirculation (EGR) cooler defect that can increase the risk of an engine compartment fire or sudden loss of power.

A similar Dodge Ram EGR cooler defect class action lawsuit was also filed in the Supreme Court of British Columbia.

Dodge Ram trucks are also listed in an FCA Canada class action lawsuit over an alleged tire pressure monitoring system defect in certain Dodge, Chrysler and Jeep vehicles.

    2019 ram 1500 sport with major electrical flaws. Yes the rotary shifter does slip into neutral or has on one occasion illuminated P for park and rolled down my driveway clearly in neutral. I have the 4 position air suspension and frequent problems of losing steering power and all control in the highway height mode. While driving the steering locks the car shuts off

    It’s not just roll away from park try transmission dying while driving and car goes into neutral in the middle of the road. 114000 km and is a known issue ….. Result transmission is toast nothing left of it. No noise prior no engine light prior no indication of any problems.no nothing just dead.

    I bought a new 2016 Ram 1500. In the summer of 2017 I parked it in front of my garage at my cottage. I had just started the engine so I left it running while I took a boat battery into the garage. About 30 secs later I am walking back to the truck when it starts rolling backwards. I had left the drivers door open so I ran the last few steps and jumped into the drivers seat and hit the brakes. The rotary gear shift dial was still in the park position. I really did not like this rotary dial system, so I just assumed that I had not properly put into Park. I hurt my foot on the running board and strained my left wrist while getting into the truck. Had I not left the door open and hence been able to get in, the truck would have started to go down hill and no doubt been a total loss.
