ONTARIO ENERGY GROUP SETTLEMENT UPDATE:


Class Members may be able to take part in a proposed $14.95 million settlement that, if approved, will end claims that Ontario Energy Group duped consumers into misleading and illegal contracts for home equipment, such as water heaters, air conditioners, and furnaces.  

Those who may benefit from the settlement include Ontario residents who entered into a lease agreement for equipment with Ontario Energy Group, also known as MDG Newmarket, between May 1, 2012 and Dec. 31, 2016. Under the terms of the proposed settlement, Class Members may receive cancellation of their lease agreement and forgiveness of any money owed.  

In addition, they may be able to take part in a new, lower-cost equipment buyout program. The buyout program will come with fixed and transparent prices that decline over time, say court documents.  

Class Members may also be able to take part in a debt management program if they have unpaid arrears and they may also benefit from a reduction in the annual increases to their monthly payments under their Ontario Energy Group lease agreement. 

The lead plaintiff, now deceased Hugh Cullaton who is represented by his estate, claimed the Ontario Energy Group went door-to-door selling contracts to lease equipment to homeowners. Cullaton alleged that the contracts were unlawful and resulted in undisclosed high monthly rental fees. In addition, the company that purchased the contracts from Ontario Energy Group, Home Trust Company, allegedly slapped liens on the titles to consumers’ homes.  

The class action lawsuit accused the company of violating Ontario consumer protection laws.  

In the proposed class action settlement, Ontario Energy Group and Home Trust Company have also agreed to clarify the termination terms of their contract and improve their lien and security registration practices.  

Class Members who do not wish to take part will need to opt out of the settlement by Sept. 13, 2021.  

The Ontario Energy Group class action settlement has not yet been approved by a court. An approval hearing is scheduled for Sept. 23, 2021.

    I wrote. The wrong date of install of our a.c unit.
    It was installed July 24 / 2017. This is the correct date.

    I have been Dupted and lied to about our purchase of an a.c u it July 28/ 2018.

    We did cancel on july 24/1017. However the guy badgered my wife into the plan when I was not home. Now there is a kind of lien on our home. Can’t ever sell without paying this off first.

    Why is this not transferable to a new owner if house was sold.

    Sounds like a total scam as enbridge just dropped them off there billing system. We where promised a $30.00 Amazon gift card if we kept paying. Never received anything after several calls to utilebill.

    I would like to know how to join this class action suit. I was dupped into contacts for a furnace, air conditioner just after my son died and we were very vulnerable and not thinking clearly. Then they promised if we took the air purifier and water filter that we would get a bundled rate that was much lower. None of this happened and instead when we asked them to come pick up the equipment, they instead put a lien on our home. Now they are taking us to court for a very large sum that is totally unreasonable. Please can you help us? Let us know what you need. Thank you

    I was tricked into what I always thought was a payment plan to purchase my air conditioner, after I had notices the supposedly fixed monthly payments were continually increasing as months went by, only to find out it was a lease approximately for 15 years or until they say when!
    When I was forced to file for bankruptcy protection, then I was told by my trustee Company that I had a lien put on my house for approximately $11,000 by Ontario energy group.
    This is not what I was told when they came to my door.

    Guys showed up stating that 2 pieces of equipment was free but mandatory by the city. Now there is a lien on my home and being the sole mortgage holder I did not even authorize the installation
    Reached out to Utillibill to come to some sort of buyout agreement but they refused to budge

    hello I too was duped into a rental agreement with Ontario consumers home srevices/ Utilebill some years ago and have been paying since . want to get rid of this rip off and possibly some of my moneys back .
    looking for advice on how or if I am able to jump on an existing lawsuit with these dirtbags .
