ONTARIO ENERGY GROUP SETTLEMENT UPDATE:
- The Court approved the settlement Oct. 21, 2021.
- The claim period is expected to open by the end of 2021 or in early 2022.

Class Members may be able to take part in a proposed $14.95 million settlement that, if approved, will end claims that Ontario Energy Group duped consumers into misleading and illegal contracts for home equipment, such as water heaters, air conditioners, and furnaces.
Those who may benefit from the settlement include Ontario residents who entered into a lease agreement for equipment with Ontario Energy Group, also known as MDG Newmarket, between May 1, 2012 and Dec. 31, 2016. Under the terms of the proposed settlement, Class Members may receive cancellation of their lease agreement and forgiveness of any money owed.
In addition, they may be able to take part in a new, lower-cost equipment buyout program. The buyout program will come with fixed and transparent prices that decline over time, say court documents.
Class Members may also be able to take part in a debt management program if they have unpaid arrears and they may also benefit from a reduction in the annual increases to their monthly payments under their Ontario Energy Group lease agreement.
The lead plaintiff, now deceased Hugh Cullaton who is represented by his estate, claimed the Ontario Energy Group went door-to-door selling contracts to lease equipment to homeowners. Cullaton alleged that the contracts were unlawful and resulted in undisclosed high monthly rental fees. In addition, the company that purchased the contracts from Ontario Energy Group, Home Trust Company, allegedly slapped liens on the titles to consumers’ homes.
The class action lawsuit accused the company of violating Ontario consumer protection laws.
In the proposed class action settlement, Ontario Energy Group and Home Trust Company have also agreed to clarify the termination terms of their contract and improve their lien and security registration practices.
Class Members who do not wish to take part will need to opt out of the settlement by Sept. 13, 2021.
The Ontario Energy Group class action settlement has not yet been approved by a court. An approval hearing is scheduled for Sept. 23, 2021.

Hi there, I am inquiring on behalf of my senior mother. She has been paying a contract for five years now and it keeps going up every year. There is a lien on her house and she entered the contract on December 15th, 2016. There have been multiple name changes of the company.

Hi my name is Larry mcgilfrey and I purchased water heater furnace and air conditioner. My wife and I had to take the biod because they put a lean on my house My Biot was $9000 That doesn’t include the monthly payments that we had already paid Am I titled to a settlement.
I too have HVAC equipment that is rented from Summitt/HVAC Canada/UtilEbill/ and who knows who now?
I’ve been duped by the original contract and repeated requests to obtain a copy of said contract have been ignored!

Hi I had to buy out my furnace and air conditioner in 2018 after paying years of fees, am I entitled to any of this settlement? I did receive a letter in July about this.

We were pressured to lease a water softener from Ontario Home Services. They sold it as a maintenance free alternative. The salesman was to come back with the manual but never showed up. I called the company to have someone call us back as we were already having issues and thats when the problem started. Never received a call back from this maintenance free agreement. I had to actually file a dispute with Enbridge. Unfortunately does not appear that we are part of this class action but these companies need to be stopped
I have a furnace and water heater that are rented from 2016 as well as a water purifier and water softener that are on a 120 month lease. The water softener and purifier were from a salesman at the door who made me feel foolish if I couldn’t see the benefit to his sales pitch.

We were pressured into renting furnace and tankless hot water heater from Simple Green Hvac company. It was door to door sale in 2014 and the contract was signed for 15 years. Every year they increase the price of rental equipment and from what we were told , contracts of 15 years are not legal.
