Day scholars will soon be able to file compensation claims to earn their share of class action settlement funds meant to resolve allegations against the Canadian government concerning years of abuse of indigenous individuals who attended residential schools during the day.
The federal court approved a settlement in September that agreed to allocate $10,000 for each former student or their descendants.
The settlement is specifically meant for day scholars who were left out of the 2006 Indian Residential School Settlement and 2019 Federal Day Schools settlement, Global News reports.
One claimant, Kayla Ironstar-Murray, told Global News she plans on filing a claim on behalf of her mother, Angela Ironstar, who she says previously attended the Lebret Indian Residential School as a day scholar.
Ironstar had previously not understood the wording of the 2006 Indian Residential School Settlement, which Ironstar-Murray says is why this time around she is choosing to operate as her power of attorney.
“It’s worded in a way where it’s not easy for everybody to read,” Ironstar-Murray told Global News. “(My mom) had asked me to help her with the actual application.”
Canada Must Also Pay $50M Into Revitalization Fund As Part Of Settlement
Part of the settlement also has Canada agreeing to pay $50 million towards the Day Scholars Revitalization Fund, which supports programs dedicated to wellness, healing, support, education, language, culture, commemoration and heritage.
Class counsel anticipates Day scholars will be able to start making claims for their share of the settlement funds starting early next year, Global News reports.
Eligible claimants are indigenous day scholars who were split from their families and forced to attend the residential schools between 1831 and into the 1990s.
Day scholars were reportedly subjected to physical and sexual abuse while at the facilities, in addition to being malnourished and disallowed from speaking their native language or practice their chosen religion.
The Canadian government continues to deny that they share any liability with what allegedly went on at the residential facilities.
