Silk, Great Value class action lawsuit overview: 

  • Who: A consumer filed a class action lawsuit against Danone Canada and Wal-Mart Canada Corp. 
  • Why: The consumer claims Danone and Wal-Mart are not adequately refunding those who purchased Silk and/or Great Value-branded plant based milk that was recalled in July over listeria contamination concerns.
  • Where: The consumer seeks to represent a nationwide class of Canadian consumers.

Danone Canada and Wal-Mart Canada have inadequate refund programs for consumers who purchased Silk and/or Great Value-branded plant-based milk that was recalled over concerns of listeria contamination.

A consumer claims she was unable to get a refund for the variety of Silk-branded plant-based milk she purchased, prior to the products being recalled in July over concerns they contained listeria monocytogenes.

“Obviously, Applicant would have never purchased these products had she been aware of the health risks,” the class action says. 

The consumer wants to represent a nationwide class of Canadian consumers who purchased the various Silk and Great Value brand plant-based refrigerated beverages that were recalled over listeria monocytogenes concerns. 

Consumers warned not to consumer, use, sell, serve or distribute recalled Great Value, Silk products

The Public Health Agency of Canada warned consumers at the time of the July recall not to consume, use, sell, serve, or distribute the recalled Great Value or Silk plant-based products, according to the recall. 

Meanwhile, the consumer argues it was impossible for her to return the products she bought  in order to complete an online request for a refund, since she and her family already consumed them and disposed of the cartons. 

“Offering refunds for products that have been consumed and cartons that have been disposed of is a completely inadequate refund program,” the class action says. 

The consumer claims Danone and Walmart are guilty of omission, breaches and negligence, and having inadequate refund programs. 

The plaintiff requests an award of compensatory, moral and punitive damages — in addition to damages for trouble and convenience — for herself and all class members. 

Two people in Ontario reportedly died in connection with the Great Value and Silk plant-based milk products recall. The Public Health Agency of Canada said those sickened with listeriosis, including the two dead, became ill between August 2023 and early July 2024.

    I bought multiple cartons before learning of the recall . Some were drank unknowingly and the rest went down the drain

    Please add me to this . I had purchased Danone and Great Value products and now I know the reason I was so ill. The store wouldn’t take the remaining products of mine and had to dump them out. Please sign me up. I wish I kept my receipts for all these throughout these months.

    It’s a scary moment when you take out a 2Lt container from your refrigerator and realize that with one inch left in the carton that you may be infected also

    I consumed the tinted product in June and July. Became very sick for over a week. Had a bacterial infection. Which triggered other issues. Wallmart did take milk back for those I had on hand. Have not drank it since I drank in my smoothies daily.

    I was violently ill two weeks after the affected product dates were made public after having consumed Silk brand almond milk regularly prior to the recall announcement. I did go to my dr and I was on prescription antibiotics for possible listeriosis

    I purchase the Vanilla and Original every week since 2015/6 for my household and never expected such a situation. I drank through 1.5 litres of the bad batches over 4 days until finding out and Metro made it difficult to return so poured it outside store.
