Two British Columbia women have filed a class action lawsuit against Deva Concepts alleging severe side effects from using the company’s products, including hair loss.

The lead plaintiffs, Penelope Ann Elton and Thea Dawn McNaught, claim they and other consumers paid a premium for Deva Concepts’ products based on promises about superior quality and results from Deva Concepts. However, the plaintiffs say that the products are falsely advertised and can cause harm to consumers’ scalp and hair.

Deva Concepts specifically markets products for curly hair, according to its website. Consumers are encouraged to combine a DevaCurl cut with the company’s hair care products.

Both of the plaintiffs say they used Deva Concepts products on their hair on a regular basis and after using the products they began to experience hair loss and thinning, painful sores on their scalps, fundamental changes in their hair shape and texture, and other side effects.

According to the complaint, “despite the Defendant’s promises, which caused many consumers across Canada to purchase and use DevaCurl Products, use of the defective DevaCurl Products causes scalp irritation, severe itching, scalp blisters and lacerations, excessive shedding, hair loss, thinning, breakage, balding, and/or other related injuries.”

In fact, consumers may have become the unwitting victims of a DevaCurl scandal. “Thousands of consumers and purchasers have reported their hair falling out shortly after or during actual use of the defective DevaCurl Products,” states the proposed Deva Concepts hair loss class action lawsuit.

The proposed Deva Concepts hair loss class action lawsuit, which has yet to be tested in court, lists the following products as defective and capable of causing severe hair and scalp problems:

  • DevaCurl One Condition Original hair conditioner
  • DevaCurl Light Defining Gel
  • DevaCurl Low-Poo Original cleanser
  • DevaCurl Low-Poo Delight cleanser
  • DevaCurl No-Poo Decadence cleanser
  • DevaCurl One Condition Delight hair conditioner
  • DevaCurl One Condition Decadence hair conditioner
  • Melt into Moisture Mask
  • Styling Cream
  • DevaCurl Leave-In Decadence conditioner
  • Super Stretch Coconut Curl Elongator
  • Wavemaker
  • DevaCurl Ultra Defining Gel
  • Flexible Hold Hair Spray Touchable Finishing Styler

The plaintiffs allege a DevaCurl controversy, in which the manufacturer failed to warn them and other consumers of potentially severe consequences of using their products.

Concerned woman looking at her scalp regarding the Deva Concepts class action lawsuit filedAccording to the complaint, “nowhere on any of the packaging for any other DevaCurl Product does it state that scalp irritation, severe itching, scalp blisters and lacerations, excessive shedding, hair loss, thinning, breakage, balding, and/or other related injuries may occur. The Defendant provides no warning about these potential consequences, and in fact makes numerous assertions about the gentle and beneficial nature of the DevaCurl Products.”

The Deva Concepts class action lawsuit points out a “myriad” of complaints made by consumers who suffered DevaCurl hair loss and other side effects, with some calling for a recall of the products. The complaint notes that, in response, Deva has posted a statement on its website reassuring consumers that the products are “safe and adhere to both quality assurance and regulatory standards.”

“Despite notice and knowledge of the problems caused by the defective DevaCurl Products, the Defendant has not recalled the deficient DevaCurl Products, has not provided any warnings of the known risks, and has denied that the defective DevaCurl Products cause the reported health issues,” allege the plaintiffs in the Deva Concepts hair loss class action lawsuit.

Further fueling the DevaCurl scandal, the defendant has also allegedly continued to encourage consumers to continue using their products and state that it is not considering a recall on its website.

The proposed hair loss class action lawsuit accuses Deva Concepts of negligence for failing to warn consumers of the reported side effects. The plaintiffs say that the company failed to take reasonable care when designing, testing, and manufacturing their products. In addition, the products were advertised in a negligent manner, says the complaint.

The plaintiffs also accuse Deva Concepts of battery for exposing consumers to defective products that caused severe physical side effects. In addition, the complaint charges the company with breach of contract and for violations of the Consumer Protection Act.

This is not the first Deva Concepts hair loss class action lawsuit filed against the company. A proposed DevaCurl class action lawsuit has been filed in Quebec over the alleged side effects of the product, including scalp irritation and hair loss, along with the anxiety and mental distress experienced by consumers who used the products.

    I have been using numerous Devacurl products for 3-4 years. For the past approx. 2 years I have noticed my hair progressively becoming much thinner and coming out in clumps when I wash it. The curl does not curl as it once did. I have also noted scattered scaly areas on my scalp. I attributed this to a probable result of aging. Then I read about the alleged problems with Devacurl products and have since stopped using all of their products. I am hoping for improved condition and thickness of my hair.

    I used deva curl 3 steps for coily hair for about 2 months. After a few weeks I noticed my hair falling and my scalp showing. I didn’t know that was from deva curl but after seing the complaints of many women on the internet now I’m sure my hair thinning was caused by using deva curl.

    I used Deva Curl for a year and had major hair loss and scalp issues. After a great deal of research, I came to understand it was the products I was using. I stopped using Deva about a month ago and already see huge changes in my hair and scalp. I wish I knew that Deva Curl was the issue sooner! How can I join this class action lawsuit?

    How can I join this lawsuit against DevaCurl? as I’ve been using their products for years and I’m experiencing itchy scalp, thinning hair, hair damage, hair loss and more .

      I have used the DevaCurl leave in conditioner for over 4 months, I found that my scalp would get irritated and itchy but I didn’t relate it to the product, until I quit using it. The front of my hair had thinned out some as well, I’ve never had a problem with thinning hair before that. I’m interested in joining this lawsuit

    I have been a user of Deva curl for 6 years. For many months now I’ve been experiencing extreme itching and burning spots on my scalp. I started loosing hair when washing as it started falling out in CLUMPS as I wash it no matter how gentle I am. Approximately 6 weeks ago I was googling to find a local Deva curl hairstylist because I needed a trim and consultation to fix what was happening to my hair, only to discover that Deva Curl was the CAUSE of the current condition. I immediately stopped using ALL Deva Curl products that day(I have been exclusive with these products for the past 6 years: shampoo, conditioner, gel, and eave cream)
    I am completely devastated and don’t know how to heal my damaged hair and scalp. Terrified of the toxins that have leached into my body causing such terrible and devastating side effects.
    I have lost so much hair you can clearly see my scalp. I have no hair at my temples-receding hairline.
    This is unacceptable that that company is not taking responsibility of this and blaming the consumer.

    I have been using devacurl for 4 years now and have experienced itchy, dry scalp, dull hair that turns frizzy by mid day. My hair has been breaking so much and has thinned out significantly. I have long curly hair to my mid back and have to cut it short because it is very thin and looks terrible. I thought it was just me aging but I am now going to stop using Devacurl products.
