Aveeno Active Naturals Class Action Settlement Overview
- Why: Johnson & Johnson was accused of falsely advertising Aveeno Active Naturals products. The company has offered to pay Class Members who file a valid claim up to $126 each to end the class action lawsuit.
- Who: Johnson & Johnson reached a proposed settlement with a consumer.
- Where: The settlement is pending in Quebec Superior Court and open for claims.
A settlement has been reached between Johnson & Johnson and the lead representative of a class action lawsuit that alleged the company falsely advertised and represented its Aveeno Active Naturals products.
The deal will set up a settlement fund of USD $675,000 converted into Canadian dollars, part of which will go towards paying Class Members for the Aveeno Active Naturals products they bought. Funds will also go towards administration costs, class counsel’s expenses, and escrow charges and taxes.
The class action lawsuit took issue with Johnson & Johnson, Johnson & Johnson Inc., and Johnson & Johnson Consumer Companies Inc. and their Aveeno Active Naturals line of beauty and skin care products. The “natural” label was misleading since the products actually contain unnatural, synthetic, and potentially harmful ingredients, according to the complaint.
Per the settlement, Johnson & Johnson have agreed to change the labelling of the Aveeno Active Naturals products. However, the Johnson & Johnson companies continue to deny any wrongdoing or liability.
This settlement is still subject to Superior Court approval.
Aveeno Active Naturals Class Action Claims
The Class includes individuals who bought at least one eligible Aveeno Active Naturals product for personal use in Canada at any time on or before Sept. 28, 2021.
Class Members must send a claim by March 11, 2022 in order to receive a payment if the settlement is approved.
Class Members who submit claims may receive a cash refund of up to CAD $3.15 for each eligible product purchased, without any proof of purchase. This is limited to 20 products per household and awards will vary depending on the number of claims submitted. Class action rebates will not exceed $126 each, according to the settlement website.
Affected individuals may also choose to opt out of the class and must do so by Jan. 3, 2022. Opting out will remove you from settlement payment eligibility, but allows you to file your own lawsuit against Johnson & Johnson if you choose.
You may also file an objection to the proposed settlement which will be considered by the Court during approval deliberations. The deadline to submit an objection is Jan. 3, 2022.
