DePuy Hip Implants Class Action Settlement Overview:
- Who: DePuy, a Johnson & Johnson company, has reached a $15.5 million class action settlement with consumers who were surgically implanted with one of two of the company’s hip implant systems.
- Why: Consumers alleged the hip implant systems surgically implanted into them were defective and required them to get premature revision surgery.
- Where: Canadian residents — excluding British Columbia and Québec — are eligible for compensation.
The Ontario Superior Court of Justice has approved a $15.5 million class action settlement between DePuy and consumers who were surgically implanted with certain versions of the company’s metal on metal hip implants.
The class action settlement monies will go into a fund created for compensating eligible Class members.
DePuy is an orthopedics company owned by Johnson & Johnson that specializes in, among other things, trauma, sports medicine, and joint reconstruction.
The Class includes consumers who are residents of Canada — excluding British Columbia and Québec — who had an ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System surgically implanted in them in Canada.
Plaintiffs in the class action lawsuit against DePuy claimed they experienced adverse effects after being implanted with the two allegedly defective systems and had to get premature revision surgery.
Class Members who did not have their implants prematurely revised but meet certain other requirements may also be eligible for compensation.
The claims period is currently open and will remain open until March 14, 2022. DePuy is not admitting any guilt by agreeing to the settlement.
