Porsche was hit with a class action lawsuit filed by a B.C. resident this week who says that the carmaker lied about the emissions and fuel economy of certain 2009 through 2017 models of the luxury brand vehicles.
Lead plaintiff, Trevor Stone, claims that he and other consumers in Canada who purchased certain Porsche vehicles did so on the basis of false marketing. Stone alleges that the automaker used a defeat device to cheat on emissions tests. The nationwide class action lawsuit contends that the vehicles both consumed more fuel and released more toxins than advertised.
Vehicles that have the emissions cheating device allegedly include:
- 2009 through 2016 Porsche Boxster and Boxster S
- 2009 though 2016 Porsche Cayman and Cayman S
- 2012 through 2016 Porsche 911 Carrera and 911 Carrera S
- 2010 through 2013 Porsche Panamera S
- 2014 Porsche Panamera Turbos
- 2015 Porsche 911 S
- 2016 Porsche Cayenne GTS
- 2017 Porsche Cayenne S
It has been a rough month for the luxury automaker who also issued a recall of its electric vehicle, the Taycan, in the United States over concerns about loose suspension components.
In his class action lawsuit, Stone says that he and other consumers wouldn’t have purchased or paid as much for the vehicles had they known about the emissions cheating device. In addition, he alleges that the resale value of the vehicles has been negatively affected by Porsche’s deception.
“Porsche’s special test mode was activated by certain entry and exit conditions,” reportedly explains the lawsuit. “In certain calibrations, the test mode was designed to be activated for some or all of regulatory testing (during which the vehicle would use less fuel and emit less C02) and de-activated under normal, on-road driving conditions (resulting in increased fuel consumption and emissions).”
The class action lawsuit points to an investigation conducted by German regulators into emissions cheating by Porsche. The emissions cheating scandal has snared several major carmakers, who now face class action lawsuits from Canadian consumers claiming they were deceived.
In fact, earlier this year, a $9 million class action settlement ended litigation over an alleged Bosch emissions defeat device used in certain Volkswagen, Porsche, and Audi vehicles.
