Bosch Emissions Class Action Settlement Reached

A $9.3 million settlement has been reached in a Bosch emissions class action lawsuit against the manufacturer of alleged emission cheating devices in certain Volkswagen, Audi and Porsche vehicles.

Several emissions cheating settlements have already been approved and benefits made available to Class Members of the claims involving 2009-2016 Volkswagen, Audi and Porsche 2L and 3L diesel vehicles. If you qualified for benefits from these earlier settlements, you may qualify for additional compensation from this Bosch emissions cheating class action settlement.

According to the Bosch emissions cheating class action lawsuit, Bosch allegedly designed and manufactured a defeat device designed to cheat on emissions testing. These defeat devices reportedly allowed vehicles to pass regulatory emissions tests even though the vehicles’ emission levels surpass regulatory maximums.

Bosch denies the allegations but agreed to settle the Bosch emissions cheating class action lawsuit to avoid the burden and expense of ongoing litigation.

Because significant benefits have already been made available to the lessees and owners of the vehicles that allegedly had the Bosch emissions cheating devices installed, the Class Definition for the Bosch settlement includes claimants who may not have had a full opportunity to claim compensation for recoverable losses in the previous emissions cheating settlements.

The Bosch emissions cheating class action lawsuit was originally certified in July 2018. The Class definition was modified last month for settlement purposes.

There are four categories of Class Members who may qualify for benefits from the Bosch settlement:

• Individuals who leased 3L Generation 2 Volkswagen, Audi or Porsche vehicles and who received lessee benefits pursuant to the 3L class action settlement. These Class Members will be eligible for a payment of $1,000 per vehicle.
• Individuals who owned 2L Volkswagen or Audi vehicles as of Sept. 18, 2015 but sold the vehicle before the 2L class action settlement pre-approval notice date (Jan. 4, 2017), and therefore received 2L settlement benefits as “sellers” instead of “owners.” These Class Members will receive a payment of $750 per vehicle.
• Individuals who owned 3L Volkswagen, Audi or Porsche vehicles as of Nov. 2, 2015 but sold their eligible vehicles before the 3L class action settlement pre-approval notice date (Jan. 17, 2018), and therefore received 3L settlement benefits as “sellers” instead of owners.” These Class Members will receive a payment of $2,500 per vehicle.
• Individuals who successfully claimed a Buyback or Buyback with Trade-In benefit from the 2L class action settlement, and at the time they surrendered their 2L vehicle, had an unused portion of warranty coverage that had been purchased for that vehicle at an authorized Volkswagen or Audi dealership that could not be transferred to another vehicle. These Class Members will be eligible for a pro rata share of the money available to pay extended warranty claims, up to a maximum payment of $500.

There will be no need for Class Members (except those seeking extended warranty benefits) to submit a Claim Form. Payments will automatically be mailed to eligible Class Members. If you have moved since you received a payment from one of the previous emissions cheating settlements, you will have an opportunity to update your contact information with the Settlement Administrator after the Bosch emissions cheating device class action lawsuit settlement is approved.

The Settlement Administrator is not yet accepting extended warranty claims for this Bosch emissions cheating device class action settlement. The deadline to opt out of or object to the Bosch emissions cheating class action settlement is Aug. 21, 2020. The approval hearing has been scheduled for Aug. 28, 2020.
