Hyundai Shattering Panoramic Sunroofs Class Action Overview: 

  • Who: An Alberta judge certified a Class of Hyundai drivers in a class action lawsuit. 
  • What: The lawsuit stems from panoramic sunroofs that shatter spontaneously due to an alleged defect.
  • Where: The claim was filed in Alberta, Canada.

A class action lawsuit alleging that Hyundai fails to warn drivers about a defect that causes sunroofs in some of its vehicles to spontaneously shatter has been certified by an Alberta judge.

Associate Chief Justice J.D. Rooke certified the class action lawsuit that was filed by Hyundai owner Robert Engen, who alleges that the company has broken state and federal consumer protection laws in regards to the alleged defect in the panoramic sunroofs.

Engen says in the claim that when designing and promoting the panoramic sunroofs, Hyundai failed to meet engineering and manufacturing challenges, resulting in sunroofs being installed that are susceptible to spontaneous shattering.

Hyundai Knew of Panoramic Sunroof Defect

Hyundai knew that the sunroofs were shattering as early as mid-2012, he alleges, but failed to disclose that the sunroofs endanger drivers. He adds that the company either intentionally or negligently made false representations about the sunroofs and provided certain warranties when selling the vehicles – then went on to breach those warranties5.

He alleges that Hyundai breached the Sale of Goods Act and the Consumer Protection Act.

Hyundai argued that it could not have breached either act in relation to the drivers because there is no privity of contract between the company and drivers, the only privity of contract is between the drivers and individual Hyundai authorized dealers. However, Rooke rejected that argument and said the company did act as the seller of the goods to the drivers.

According to the class action lawsuit, there are hundreds of reported instances of the panoramic sunroofs shattering, and there are scientific reasons for the modes of failure.

“This is not an isolated issue which affected Engen, there are hundreds of other reported instances in evidence.”

Rooke also ruled there appeared to be evidence of a common defect across the Class.

This is not the first class action Hyundai has faced over the panoramic sunroofs. In 2019 the company reached a settlement with drivers, whereby Class Members could trade their vehicle in for a Hyundai without a sunroof, and claim an additional $1,000. Those who decided to sell their Hyundai and replace it with a non-Hyundai vehicle, could claim up to $600.

    2013 Hyundai Santa Fe sunroof shattered on Dec 14, 2023 while driving on a residential road in St. Albert. Luckily liner was closed to protect from glass debris.

    Today (July 6, 2023), on the way to work, my 2016 Hyundai Santa Fe Sport sunroof front glass panel exploded. Like as other of said, no warning, nothing hit it, just a loud noise and glass shards falling into the car as I did not have the cover closed.

    On June 29th 2023, I was driving my vehicle Hyundai Santa Fe 2023 calligraphy on an interstate. I heard a loud explosion and it threw me off for a bit and I noticed a huge hole on the sunroof. My reaction was similar and I thought something had struck. But when I looked at that big hole I found out the angle of the explosion towards top and it was not due to something hitting it. My friend told me it could have happened because of the glass unable to withstand and balance the temperature between inside and outside the car. I am not fixing it myself as it is a manufacturing defect and it was a life threatening incident.

    Twice my 2017 Hyundai Santa Fe panoramic sunroof has exploded. The first time the dealership replaced it then it shattered again this month, June 2023, and I was told none of the extended warranty’s would cover glass loss. It is obvious that this is a design flaw of the Hyundai vehicles. I owned a Hyundai Veracruz previous with just a normal sunroof and had zero issues. Luckily both instances I had the cover closed so was not covered in broken glass.

    Hello, Today (June 07, 2023) morning around 7:30 AM I was driving my Hyundai Palisade (2020 Preferred model) and suddenly heard a loud noise in the Sunroof, I opened the internal sunroof hood and glass pieces showered on me and within the car. First thing I searched is the probable object by which sunroof might have been broke, but to my surprise neither sunroof hood was damaged (as it was closed when sunroof explode) nor I found any object which could have smashed the sunroof. This is clear case of defective sunroof glass, which Hyundai should be responsible.
    I have submitted my Palisade with Ajax Hyundai today and awaiting their response whether Hyundai will repair this sunroof defect on their own.
    Please advise me, how to participate as a claimant to this lawsuit. Thank you.

    My 2019 Huyndai Tuscon sunroof expoded today (June 8, 2023) while driving on a clear road, no cars around, clear weather. Gunshot sound and shattered glass…thankfully the rooftop cover was closed and my kids weren’t in the car. Huyndai refuses to pay for repairs as glass is not covered under their warranty. There are so many cases of this happening and yet Huymdai refuses to recall/cover it in tbeir warranty. Time for another class action lawsuit against Huyndai?!

    My 2017 Hyundai Tucson, sunroof exploded today, Sunday, 4/23/2023, while I was driving on the highway. I will find out tomorrow what it will cost me to have it repaired.

    My 2020 Hyundai Tuscon front strip to the Panorama sunroof mysteriously shattered. Are we opening a new class action lawsuit? The stories continue on the internet for newer models, Hyundai is unresponsive to me. I even filed a BBB complaint with no response. My name is starrynoche on IG – pls let’s make another class action. They are aware and do not care!!! I can’t even wash my car!!!
