Honda Canada has recently reached a nationwide class action lawsuit settlement, bringing Canadian Takata airbag inflator class action lawsuits to a close. If you purchased or leased a defective Honda or Acura vehicle, you may be entitled to a cash reimbursement.

The Honda airbag settlement ca settlement is awaiting court approval in Quebec and Ontario.

The Takata airbag inflator class action lawsuits Canada concern airbag inflators manufactured by Takata, known as Takata PSAN Inflators. The class action lawsuits allege that the Takata PSAN Inflators installed in certain Honda and Acura vehicle are defective, resulting in various damages to Class Members.

A similar Canadian settlement concluded by Mazda, Subaru, and Toyota has already been approved in 2019, and resolves another Canadian class action lawsuit relating to vehicles equipped with recalled Takata airbags.

The proposed Takata airbag inflator class action lawsuit settlement provides for the reimbursement of certain out-of-pocket expenses incurred by Honda Canada customers. The settlement also establishes continued activities by Honda Canada to recover recalled airbag inflators from scrap sellers through its Takata airbag inflator re-purchase program.

Class Members included in the Takata airbag inflator class action settlement are Canadian residents, including automotive recyclers, who are current owners and Honda recalled airbaglessees of a covered vehicle, or those who formerly owned or leased a covered vehicle, and sold or returned their vehicle after being notified of a Takata airbag inflator recall and before the date of the settlement approval by the court.

The vehicles covered by the Takata airbag inflator class action settlement are as follows:

  • Honda Civic (2001, 2002, 2003, 2004, 2005, 2006, 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015)
  • Honda Crosstour (2010, 2011, 2012, 2013, 2014)
  • Honda CR-V (2002, 2003, 2004, 2005, 2006, 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, 2016)
  • Honda CR-Z (2011, 2012, 2013, 2014, 2015)
  • Honda Element (2003, 2004, 2005, 2006, 2007, 2008, 2009, 2010)

Honda does not admit and expressly denies any  liability for any such defects in Takata PSAN inflators in the Honda class action lawsuit 2020. As a result of the class action lawsuit settlement, Class Members will be able to obtain the settlement benefits and in exchange, Honda will be released from liability.

Class Member eligibility for settlement benefits depends on several factors.

Eligible Class Members may be entitled to a cash reimbursement payment from Honda by submitting a settlement claim under the Customer Out‐of‐Pocket Expense Program. This settlement program is intended to reimburse reasonable out‐of‐pocket expenses, such as alternative transportation and storage expenses.

The Customer Out‐of‐Pocket Expense Program benefit is not available to automotive recyclers.

Additionally, the Takata airbag inflator class action rebate provides for a Customer Support Program. The program offers Class Members prospective coverage for repairs and adjustments needed to correct defective and/or damaged materials in original Takata PSAN Inflators in covered Vehicles and replacement driver’s‐side or passenger’s‐side front airbag inflators installed pursuant to a recall.

A settlement approval hearing will be held in Toronto, Ontario by the Ontario Superior Court of Justice on Dec. 22, 2020 at 10:00 a.m. by video conference.

The deadline to object to the settlement is Oct. 21, 2020, and the opt out deadline is Nov. 20, 2020.

    I keep getting letters from Honda Canada about every 6 months. It’s a 2010 Honda Civic EX-L and it costs me money for gas and I have a CAA module in my OBD2 port so it also costs me money in insurance to drive to Honda and back. After reading no deaths or injuries in Canada I’ve decided to never get it fixed unless I sell the car. I’m personally against air bags in cars and given the option I would always buy cars with no airbags to save money on the price of the car. I believe seatbelts should only be mandatory on highways or not mandatory at all like they used to be eons ago.
