Mazda, Subaru, and Toyota recently agreed to settle Canadian class action claims relating to their vehicles equipped with recalled Takata airbags.

The settlement will benefit Canadian consumers who own, owned, lease, or leased a vehicle from Mazda, Subaru, Toyota, and other brands affected by the Takata airbag inflator recalls. A full list of eligible vehicles can be found in the “Who’s Eligible” section below.

Plaintiffs in several class actions against Mazda, Subaru, and Toyota claimed that the automotive companies manufactured and sold vehicles containing defective Takata airbags.

The defective airbag inflators could allegedly fail to explode upon deployment, causing debris and shrapnel to be expelled into the vehicle. Due to these defects, the Takata products have reportedly been recalled.

The automakers have not admitted to any of the claims brought in the several Takata class action lawsuits. Instead, the companies have agreed to settle the claims against them as a way to resolve the allegations without the costs and risks associated with future litigation.

The settlement provides reimbursement for any documented expenses that stemmed from the repair of recalled Takata airbags, including car rental, towing charges, childcare expenses, and other costs. The settlement also provides non-monetary relief programs to help with consumer outreach and repair costs.

In order to benefit from the settlement, consumers have to file a valid Claim Form. The claim deadline varies from one year after the final approval hearing to one year after March 2020 repairs, returns, or sales.

The deadline for exclusion is Jan. 17, 2020. The deadline for objection is Feb. 3, 2020. The final approval hearing in Ontario is scheduled for Feb. 11, 2020 while the final approval hearing in Quebec is scheduled for Feb. 17, 2020.

Who’s Eligible

Canadian consumers who own, owned, lease, or leased a vehicle from Mazda, Subaru, Toyota, and other brands affected by the Takata airbag inflator recalls.

Eligible vehicles include the following:

  • Lexus vehicles: 2007 to 2012 ES350; 2010 to 2017 GX460; 2006 to 2013 IS; 2010 to 2015 IS250C/350C; 2008 to 2014 IS-F; 2012 LF-A; 2002 to 2010 SC430; 2016 to 2019 IS200T/300/350; 2006 to 2009 and 2014 to 2015 IS250/350; 2015 to 2019 RC-F/350/300/200T;
  • Mazda vehicles: 2004 to 2013 Mazda 6; 2006 to 2007 Mazda Speed 6; 2004 to 2011 RX-8; 2004 to 2009 B-Series; 2004 to 2006 MPV; 2007 to 2012 CX-7; 2007 to 2015 CX-9; 2010 to 2013 Mazda3; 2011 to 2014 Mazda2;
  • Saab vehicles: 2005 to 2006 Saab 9-2X;
  • Scion vehicles: 2011 to 2015 XB; 2016 iM;
  • Subaru vehicles: 2003 to 2006 Baja; 2009 to 2013 Forester; 2005 to 2011 Impreza; 2003 to 2017 Legacy; 2003 to 2017 Outback; 2004 to 2014 STI/WRX; 2006 to 2014 Tribeca;
  • Toyota vehicles: 2017 to 2018 Corolla iM; 2003 to 2019 Corolla; 2003 to 2014 Matrix; 2004 to 2005 RAV4; 2002 to 2007 Sequoia; 2011 to 2014 Sienna; 2003 to 2006 Tundra; 2006 to 2011 Yaris (hatchback); 2007 to 2012 Yaris (sedan); 2010 to 2017 4Runner.
Potential Award

Reimbursement for out-of-pocket expenses including car rental, towing charges, childcare expenses, and other costs directly associated with repairing Takata airbags.

The settlement also provides non-monetary benefits in the form of outreach programs and customer support programs. The programs will help provide consumer outreach to increase remedy completion rates and coverage for repairs and adjustments.

    Does anyone know if there’s going to be any kind of lawsuit against Mitsubishi/GM in the US for faulty airbags & seatbelt & no EOS system was put in my SUV so it rolled easily & the roof caved in crushing my head & it was top heavy! I’m praying to God there will be because my accident attorney filed for bankruptcy and never followed through with my case!

    I have tried filling the online form to include expenses incurred when I went to Lexus dealershio to have airbag replaced. I have also attached documents pertaining to my claim. However I am unable to deliver the form on line.
