Indian Day School Email Scam Overview:
- Who: Six Nations Elected Council issued a warning to Indian Day School class action claimants.
- Why: Scammers are sending out emails to those who participated in the Indian Day School settlement claiming that they have additional money due; however, these claims are false, warned the council.
- Where: Claims are trickling in from more than 120,000 Class Members living across Canada — all of whom may be a target.
Indian Day School class action settlement participants should be wary of emails falsely claiming that they may be entitled to additional money, warned the Six Nations Elected Council.
Class Members are receiving emails telling them that law firms other than the one handling the class action settlement can get them more money; however, the Six Nations Elected Council says that this information is misleading, reports Two Row Times.
“We’re putting the community on notice that other legal firms are also reaching out to individual[s] [with the] message that they can assist them with this,” Chief Hill told reporters, noting that the council is planning to also hold meetings to further warn Class Members.
A lawyer from the firm handling the settlement reportedly told the council that these messages may be misleading because, for Class Members who have received payments, this information is just not true under the terms of the agreement with the federal government.
Indian Day School Class Action Settlement
The Federal Indian Day Schools class action lawsuit, filed in 2009 by plaintiff Garry McLean, took issue with the forced attendance of Aboriginal students at Indian Day Schools throughout Canada. In March 2019, the plaintiffs announced that they had reached a class action settlement with Canada that would compensate survivors for the abuses they suffered while attending the federally operated Indian Day Schools.
Class Members in the Indian Day School class action settlement include those who attended Federal Indian Day School(s) and Federal Day School(s) funded, managed and controlled by Canada, and suffered abuse or harm from teaching staff, officials, students and other third parties at the school.
Class Members can claim between $10,000 to $200,000.
The Federal Indian Day School Settlement Claim Form allowed eligible Class Members to claim $10,000 without providing documentation and more to those who suffered increasingly severe forms of abuse; however, some criticized the format of the paperwork, contending that it failed to inform Class members about compensation available for common types of abuse the students experienced, such as belt strappings.
Initially, a $1.27 billion class action settlement, a final report issued in March indicated that the government paid out more than $3 billion to claimants.
Nearly 120,000 claim forms have been submitted, the lawyer reportedly told the Six Nations Elected Council and 72 percent of those claims have been paid.
“Claims are just trickling in at this point,” he said. “The bulk of claims have already been filed.”
Class Members have until July 13, 2022 to submit a claim.
