PornHub, MindGeek Class Action Lawsuit Overview:

PornHub hosted videos of a plaintiff in a class action lawsuit pending against the site’s maker, MindGeek, being sexually assaulted as a minor, according to CityNews, a Toronto news website

‘Jane Doe’ says she was raped and sexually abused by a family member for several years. She recently discovered numerous videos of her assault on PornHub, some of which occurred when she was only 12 years old, when a former high school friend sent her a link to the content. 

“I feel like it had to have been so incredibly obvious to anybody watching it that this was a child and I thought that if this ever existed on the Internet that, you know, it’s on the dark web where people are intentionally going to look for this, and it’s not for public consumption,” Doe told CityNews.

PornHub, a Montreal-based website run by MindGeek, has been accused of sharing nonconsensual pornographic videos, human trafficking and disseminating child pornography. MindGeek has faced several lawsuits in Canada and the United States, recently settling in one class action involving 50 women who alleged they were tricked into taking part in a human trafficking ring.

Doe, who is leading separate litigation against PornHub’s maker, says she tried to get her content taken down, but only received a generic response when she contacted MindGeek. 

“It sucks. It really sucks. It really sucks to think that it doesn’t matter how old I am, that my sexual abuse as a child is immortalized in videos and not just on somebody’s private computer, but on the internet, and it’s never going to go away,” Doe told City News reporters. .

Pornhub Contains Nonconsensual Pornographic Content Permitted by MindGeek, Claims Class Action

The class action lawsuit alleges MindGeek and PornHub feature disturbing content, including sexual assaults, rape and even child sex abuse.

The defendants include Montreal-based 9219-1568 Quebec Inc., MindGeek s.a.r.l., MG Freesites Ltd, MG Freesites II Ltd and MG Content RT Limited, collectively known as “MindGeek.” 

The plaintiff claims that these companies run several websites with disturbing content; however, MindGeek has incorporated numerous subsidiaries and other business entities around the world to dodge its liabilities, in addition to sheltering assets.

The class action lawsuit alleges that MindGeek and its affiliated companies reap huge profits from the nonconsensual images and videos on its websites.

“The availability of non-consensual content, including but not limited to, photos and videos of sexual abuse and sexual assault, including those of minors, on the offending websites is a direct and foreseeable result of those sites’ failure to elicit the consent of persons in the photos and videos and to comply with the applicable legal obligations,” claims the class action lawsuit.

The lawsuit claims that MindGeek failed to implement policies and procedures that would have stopped nonconsensual material from reaching its websites. In addition, the companies allegedly failed to hire enough content monitors to review PornHub content.

The plaintiff seeks to represent those with intimate videos or photos of them that were posted on websites owned by MindGeek, including PornHub, without their consent since 2007.

“It is a fundamental human right for persons to have control over the dissemination of intimate images and videos of oneself,” states the class action.
