capital one bankA Capital One class action lawsuit accuses the bank of not doing enough to protect Canadian customers from a data breach that occurred in the spring of this year.

Plaintiff Adele J. Taylor says she was issued a Capital One Platinum Costco Mastercard and had an online account. Taylor claims that her personal information was compromised in a data breach that occurred between March 12 and April 21 2019.

Allegedly, the data breach occurred when Ms. Paige A. Thompson, a hacker, took Data from Capital One’s directories stored on a server. Thompson reportedly did this by accessing the server through a misconfigured web application that Capital One had rented from Cloud Computer Company, to store customers’ credit card applications and personal information.

The Capital One data breach class action lawsuit says that the affected data includes information of Canadian consumers and small businesses who applied for credit cards with Capital One between 2005 and 2019.

This data allegedly includes names, dates of birth, mother’s maiden name, Social Security numbers, addresses, email addresses, phone numbers, employment status, and financial information.

The Capital One data class action lawsuit says that Thompson had possession of Taylor’s personal information since as early as March 2019. According to Taylor, it is likely that Thompson has shared this information with others, either by selling it or distributing it to other people who will release it online.

The Capital One data breach has forced many customers to take steps to protect their financial information, says Taylor. This includes purchasing credit monitoring protection services and identity protection services, monitoring their credit reports, notifying their financial institutions, among other actions. 

Customers were also put at risk for financial injury in the form of fraud and identify theft. Additionally, customers’ credit may have been affected, which can limit their ability to obtain credit in the future.

The Capital One bank class action lawsuit asserts that Capital One should have done more to prevent the data breach.

Allegedly, the company did not take sufficient security measures to protect information. Taylor also says that the company knew or should have known that if they did not implement sufficient security, a data breach could occur that could affect customers.

Additionally, Taylor’s data breach class action lawsuit says that Capital One failed to notify Class Members of the breach in a timely manner. Allegedly, this prevented customers from taking action to protect their information in light of the breach.

A similar Canadian class action lawsuit was filed over the same data breach earlier this year.
