settlement website has been set up for Canadian Class Members who had their personal information stored on a data tape with DaimlerChrysler Financial Services Canada Inc. (now known as TD Auto) which was lost in transit in March 2008.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

DaimerChrysler has agreed to pay Class Members for losses connected to the lost personal information as well as $20 CAD per hour for time spent dealing with the fall out, for up to two hours. The total amount of the settlement fund is $175,000 CAD.

Class Members include residents of Canada who had personal information stored with DaimlerChrysler Financial Services on a data tape that was lost or perhaps destroyed on March 12, 2008.

Class Members must have suffered an actual and direct loss as a result. Class Members may have been notified of the incident in a letter from DaimlerChrysler Financial Services dated March 27, 2008 or in February 2016.

To make a claim, Class Members will eventually need to submit a Claim Form. The Claim Form should be available by the time the court approves the DaimlerChrysler Financial Services lost data class action settlement agreement. The settlement hearing is scheduled for Feb. 27, 2020 in Montreal, Quebec.

Class Members can claim a “substantiated loss” resulting from the DaimlerChrysler Financial Services lost data. A substantiated loss must be supported by objective, reliable, and credible evidence, such as a credit card statement, invoice, or receipt. Class Members can claim more than one substantiated loss.

Some examples of substantiated losses provided on the DaimlerChrysler Financial Services lost data settlement website include unauthorized charges, as well as bank fees, such as late fees, returned check fees, etc.

In addition, Class Members who were forced to pay higher interest rates due to problems with their credit score associated with the lost data can make a claim for a substantiated loss.

If Class Members had to hire someone to fix their credit report, purchase credit monitoring services, a credit freeze, or credit reports due to the data loss can also make a claim.

Class Members can also claim up to two hours of “lost time.” Under the terms of the DaimlerChrysler Financial Services lost data class action settlement, $20 CAD per hour will be paid for each substantiated loss; however, a claim for lost time cannot be submitted without a correlating substantiated loss.

No deadline has been set for Class Members who wish to make a claim at this time. The deadline for Class Members to object to or exclude themselves from the DaimlerChrysler Financial Services lost data class action settlement is Feb. 12, 2020.
