Guelph Dental Unsterilized Tools Class Action Lawsuit Overview:

  • Who: An Ontario judge has certified a Class Action against Guelph Dental Associates regarding unsterilized tools 
  • Why: Complaints were filed to public health inspectors alleging that the practice may not sterilize it tools properly

A class action lawsuit alleging that Guelph Dental Associates used unsterilized tools and put patients at risk of contracting HIV has been certified by an Ontario judge.

Justice Paul Perell of the Ontario Superior Court wrote that “the Plaintiffs move for certification of the action as a class proceeding for settlement purposes” and said he was satisfied the requirements for certification were met, Global News reports.

The Guelph Dental class action lawsuit was filed in 2017 after the practice, which was then known as Growing Smiles, was closed down by Wellington-Dufferin-Guelph (WDG) Public Health after it was discovered that dental instruments may not have been sterilized properly.

Unlike restaurants, tattoo parlours, or hair and nail salons, dental offices in Ontario are not regularly inspected by public health units. Instead, health inspectors respond to complaints made by the public. 

In this case, public health inspectors received a complaint about the clinic and, following a site inspection, temporarily closed the practice down due to dental instruments possibly not being properly sterilized.

WDG Public Health sent letters to 3,600 patients of the clinic, suggesting that they get tested for hepatitis B, C, and HIV due to sterilization concerns.

A spokesperson for WDG Public Health told Global News that there had not been any actual infections connected to the dental clinic.

“The Plaintiffs allege that the Defendants were negligent in providing dental service at the dental clinic known as ‘Guelph Dental Associates’ and exposed their patients to certain communicable diseases,” Perell wrote in his certification of the Class.

The defendants in the case are Dr. Meikle Dentistry Professional Corp., Dr. Katherine Zettle, Dr. Kanisha Campbell, Dr. Ladan Mansouri, and Dr. Andrew Meikle.
