Fiat Chrysler Automobiles (FCA) is facing a class action lawsuit claiming negligence as a result of faulty, unrepairable vehicles that could cause accidents or injury to drivers.

Fiat Chrysler is under fire after Transport Canada received 24 recalls that included major defects that cannot be fixed. “Defects to the Class Vehicles are fundamental defects in design and manufacture and cannot be remedied. The Defendants negligently designed, manufactured, and marketed the Class Vehicles,” the Fiat Chrysler class action lawsuit states.

Fiat Chrysler Admits to Failures to Remedy Recalled Vehicles

In July 2015, the U.S. National Highway Traffic Safety Administration facilitated a public hearing to conclude whether or not Fiat Chrysler failed to fix safety flaws and announce mandatory recalls in 23 vehicles. The hearing’s determination found that Fiat Chrysler Automobiles did not sufficiently fix dangerously defective vehicles in a reasonable time frame, nor did they issue recalls to owners in a timely manner.

FCA admitted they had failed to issue required recalls to drivers and they admitted failure to fix defective vehicles. 

Plaintiff Corrine Kane from Regina, Saskatchewan bought a 2007 Jeep Liberty that was affected by a dangerous recall.

The FCA class action lawsuit Canada alleges the recalled vehicles’ defects make the automobiles dangerous to drive and can put owners, passengers, and other drivers on the road at risk. The Fiat Chrysler recalls allegedly increase the risk of injury or death in the event of an accident. Furthermore, Fiat Chrysler vehicle owners face loss of value on their vehicles due to the defects.

The FCA recalls class action lawsuit alleges that the carmaker “researched, developed, designed, tested, manufactured, marketed, distributed, and sold” the now-recalled faulty vehicles to unassuming buyers across Canada. The Class Members own, lease, or use one of the recalled Fiat Chrysler vehicles. 

Negligent Manufacturing Results in Fiat Chrysler Recalls

There is a flurry of dangerous FCA defects from flawed airbags, to faulty brakes, to damaged wiring. In total, there are 24 FCA recalls to be aware of.

The following Fiat Chrysler vehicles have an ignition switch glitch. The flawed ignition switch can slip out driving mode while the vehicle is in motion, causing the power steering, brakes, airbags, and seat belts tension to disable causing injuries or accidents. 

  • 2008 Chrysler 300
  • 2008 Dodge Charger
  • 2008 Dodge Magnum
  • 2008 – 2010 Chrysler Town & Country
  • 2008 – 2010 Dodge Grand Caravan
  • 2009 – 2010 Dodge Journey
  • 2006 – 2008 Jeep Commander
  • 2005 – 2008 Jeep Grand Cherokee

Two dangerous braking recalls were discovered and these defects can lead the parking pawl to cease operation which can cause the vehicle to start while the vehicle is in “park” after releasing the brake pedal. These Fiat Chrysler’s were recalled for faulty brakes.

  • 2015 Chrysler 200
  • 2011 – 2014 Dodge Durango
  • 2011 – 2014 Jeep Grand Cherokee

An alternator flaw escalates the risk of a sudden failure of the alternator, which can cause the engine to stall and the vehicle to lose power. The alternator flaw affects the following vehicles.

  • 2011 – 2014 Chrysler 300
  • 2011 – 2014 Dodge Challenger
  • 2011 – 2014 Dodge Charger
  • 2011 – 2014 Dodge Durango
  • 2012 – 2014 Jeep Grand Cherokee

One make has been affected by a door switch issue. The car doors can open unexpectedly while driving.

  • 2013-2014 Dodge Viper

The following have been found to have an erroneous rear axle pinion nut. The rear axle pinion nut can come loose or completely detect, resulting in the rear wheels to lock. This can cause loss of control of the vehicles.

  • 2009-2010 Dodge Dakota
  • 2009 Dodge Durango
  • 2005, 2009-2010 Dodge Ram
  • 2011-2012 Ram 1500

Dodge Rams have been hit with another class action lawsuit over faulty air suspension systems.

The following vehicles were manufactured with a dangerously placed fuel tank. The fuel tank issue is associated with cars with a gas tank near the rear axle.   • 2010-2014 Ram 2500
  • 2010-2014 Ram 3500
  • 2010-2014 Ram 4500
  • 2010-2014 Ram 5500

  • 2015 Dodge Charger
  • 2012-2013 Dodge Durango
  • 2012-2013 Jeep Grand Cherokee
  • 1993-1998 Jeep Grand Cherokee
  • 2002-2007 Jeep Liberty

The following Fiat Chrysler vehicles have a tire defect. The tires on these vehicles have not been properly put on.

  • 2014-2015 Ram 4500 
  • 2014-2015 Ram 5500

Several models have defective airbags. The airbags can deploy suddenly without cause.

  • 2002-2004 Jeep Grand Cherokee
  • 2002-2003 Jeep Liberty
  • 2003-2004 Dodge Viper
  • 2014-2015 Jeep Cherokee
  • 2003-2004 Dodge Viper 
  • 2002-2003 Jeep Liberty

Damages Due to Endangered Drivers

The Class Members are seeking damages for at least one of the following, termination of their vehicles sale or lease, compensation for the price of the bought or leased recalled vehicles, damages for costs related to the defects, loss of use, loss of car value, damages for anxiety, and punitive damages.

FCA is accused of negligence, breaching the duty owed to drivers, breach of express and implied warranty, violations of competition legislation, violations of consumer protection legislation, and unjust enrichment.

    I own 2015 Chrysler 200c, the car has software issue that dealer so far can’t fix. When I’m driving the car at random times error comes up “Performance shifting Disabled”, followed by engine light and Traction control light. The car then slows down and is stuck in a low gear with maximum speed of about 50-60 km/hr. Additionally power stirring is not working making car harder to steer. It’s scary when it occurs on the highway. So far dealer charged my $550 for “software update” and the day later same issue came up. Please add me to the class action suit, this car is unsafe and Transport Canada should do something about it.

      I have the same Chrysler 200C and the same issue. It just happened today as I’m driving to go to work. And yes it is scary.
      And this issue needs to be fixed before it’s to late.

    I’ve had an oil over consumption issue with my 2015 Jeep Cherokee since day one. I found a class action in the US for this but not in Canada. Just found out there is a also a airbag issue from this website.

    I have a 2012 Durango with stalling issues. They did the TIPM recall but still have stalling issues. Not being helped by dealership.

    Vehicle stalls when reducing speed and power is lost – power steering, power brakes, no gas pedal. Very dangerous.

    Been in to dealership numerous times, waited for recall to come out, and issue still persists. How do I get involved in lawsuit?
