Marihuana Medical Access Program Health Canada Data Privacy Class Action Overview:

  • Who: The Federal Court of Canada has given the green light to a class action lawsuit filed against Health Canada by Marihuana Medical Access Program participants
  • Why: The participants say they were mailed letters about the program with the title of the program on the envelope, violating their privacy
  • Where: Canada

A Canada court has given the green light to members of the Marihuana Medical Access Program who are suing Health Canada for sending them letters in the mail with the name of the program clearly printed on the envelope.

On May 20, lawyers for the plaintiffs reported the Federal Court of Canada had authorized the class action against Health Canada on behalf of “all persons who were sent a letter from Health Canada in November 2013 that had the phrase Marihuana Medical Access Program on the envelope.”

According to the class action lawsuit, Health Canada breached the privacy of members of the Marihuana Medical Access Program when it sent the approximately 40,000 letters to participants in the program in November 2013.

Plaintiffs Seeking Financial Compensation

Their privacy was allegedly breached because the letters were sent in envelopes referring explicitly to the “Marihuana Medical Access Program” or “Programme d’accès à la marihuana a des fins médicales”.

The plaintiffs are asking the Court to order Health Canada to pay compensation to those whose privacy was allegedly breached by the mail outs.

Health Canada reportedly denies that it did anything wrong, and is fighting the case.

Those who are part of the Class of program participants who received the letters in the mail do not need to do anything to be represented in the class action.

“If you do not wish to participate in the class action, you must opt out by sending an opt-out request to Trilogy Class Action Services by July 21, 2022,” the law firm representing the plaintiffs said.

A judge will decide if Health Canada is liable at a trial. The date for that trial has not yet been set.

Meanwhile, a recent data breach that saw the sales and revenue information of multiple Ontario cannabis stores published could impact the stores negatively, industry experts say.

The Ontario Cannabis Store (OCS), a Crown agency that distributes marijuana crafted by licensed producers to retailers, announced the data leak May 10, The Canadian Press reports

It says in a letter to retailers that the Ontario Provincial Police are investigating after some of its sales data was “misappropriated, disclosed and distributed unlawfully.”
