The Ontario government has agreed to a proposed settlement for certain Crown Wards who suffered physical or sexual abuse.

Anyone who was alive as of Jan. 22, 2012, and was a Crown Ward in Ontario at any point from Jan. 1, 1966, to March 30, 2017, and suffered physical or sexual abuse while a Crown Ward would be eligible to benefit from this settlement.

Individuals who were still Crown Wards or were in extended society care as of May 11, 2021, would not be included.

The class action lawsuit claimed Ontario had an obligation to consider and apply for compensatory benefits on behalf of Crown Wards who were victims and did not do so.

The province denies the claims against it but has agreed to a settlement in this case.

An approval hearing in the case is scheduled for May 12, 2021.

During the hearing, the Court will consider the fairness of the proposed settlement to Class Members and consider any objections that have been filed.

Class Members do not need to attend this hearing, but may choose to at their own expense.

Those who wish to speak at the hearing may request permission from the Court if they wish to object to the settlement. Anyone wishing to speak must file an objection form indicating the request to speak. 

The deadline to object to the settlement is April 1, 2021.

The objection form must be mailed to the settlement administrator or emailed to info@ontariocrownwardclassaction.ca.

If the settlement is approved, Class Members will be eligible to receive up to $3,600. The settlement website notes this money is not compensation for any crime, but rather for the fact the Crown Wards did not receive the benefits available to crime victims.

Class Members will be able to continue or launch their own lawsuits to pursue compensation for harm caused by alleged crimes.

The time period to file claims for compensation has not yet begun, and there is no money available at this point. More information about the claims process will become available if and when the Court approves the settlement.

    I’d love to know how they ask us to tell them about our experiences and we hear nothing about it and apparently can’t get information on how to even get your records properly to have information. They should be accountable for the damage they have caused generations.
    I cant stand that I was shamed and scared into stuffing the horrible events I encountered. jeeez i sure stuffed some things way down as at 51 I am just remembering being forced to lie in court as a 10 year old thrown in housing situations and detentions centres with jaded teens and violent people. I got tough fast, am a decent person and a loving mom and apologize to my 4 adult kids on my over protective nature – it would be nice to be able to explain properly what that kind of experience does to a person.

    I was a crown ward from 1969-to 1974 I had a civil lawsuit against the Queen in right of Ontario under legal aid for 13 years.[2015] The judge in the case decided I must take the settlement and placed a gag order on it. I was the last legal aid civil case allowed. No one is now able to get legal aid to try to get justice against the abuse of this province’s CAS.

    Filing for objection was 2021 so where does that leave those of us who were treated inhumanely by the Ontario government
    I wrote to you years ago and you told me you couldn’t help now I see others again being compensated again I received nothing
    Residential school training school foster homes group homes Goderich mental institution how much is all of that worth being a ward of the Ontario government’s abuse system

    Hello I was forced into cash crown ward as my father tochildrens aid wasn’t fit to take proper care of me my mother didn’t want to take me so I became a crown ward at the age of 12 the first place they had put me was in a town far from my father in Oshawa Ontario it was a huge home family of five two children and husband and wife they had placed into the molding basement which was dark bugs cold stinky and a old man that had a room next to mine I found out that old man was a pedophile alcoholic scary monster.i was only aloud to go upstairs to do all hires and have one meal a day no breakfast or snacks lunch just dinner bccuz of their strict religious beliefs only fishand rice or potatoes were the only things on the menu it was pure hell and I 2anted to run away but had no clue were I was and how to get back to Toronto I wasn’t aloud to use phone and had a plethora of rules to follow. I became a victim of sexual mental physical abuse by to he foster parents and the old man next to me inthe basement I had no lock on my door and I was subjected to the abuse for a couple months then a 15 yr old foster brother moved downstairs with me and that pig the foster kid had noticed almost 1 day the abuse and miss treatment of the foster parents upstairs thank goodness the foster brother complained about the abuse I was getting constantly to children’s aid right away I was questioned about the foster parents upstairs and the abuse I had endured downstairs so they also questioned the foster brother and we both were removed from that foster home and placed into another Foster home bcuz of the age and being that wasn’t the first time I had been sexually abused I was 12 I thought why isn’t that old pig being arrested it’s like nobody except for the foster brother cared.

    I was a crown ward abused in care , I would run away and the police would hand me back i would be inspected in the basement by the “doctor” and then lock in a solitude closet for weeks and months or placed in a chair to sit for hours or risk the closet or the blanket treatment. Clothes were a privilege . A privilege i had to earn. What was done to me & my body at the hands of the CCAS is criminal. Please give me back my voice. contact me.
