Caterpillar will pay $8 million as part of a settlement to resolve class action lawsuit claims surrounding its diesel engine performance.
The settlement benefits original Canadian purchasers or lessees of vehicles powered by Caterpillar EPA 2007 Compliant C13 and C15 diesel engines with Advanced Combustion Emissions Reduction Technology manufactured from 2005 to 2009.
Caterpillar makes a number of engines which can be used in trucks and other vehicles. Unfortunately, according to legal action against the company, certain engines produced by the company are defective due to emissions technology aimed to meet 2007 EPA standards, according to Equipment World.
According to the Caterpillar diesel engine class action lawsuit, the exhaust emission control systems in EPA 2007 Complaint C13 and C15 Caterpillar diesel engines failed to perform as expected. These engines, manufactured from 2005 to 2009, are equipped with Advanced Combustion Emissions Reduction Technology that allegedly causes the engines to lose horsepower and shut down.
When consumers’ engines broke down, Caterpillar technicians were allegedly unable to effectively repair the issue. Plaintiffs in the Caterpillar engine class action lawsuits claim they were financially damaged by the defective engines when they suffered from diminished vehicle value and out of pocket costs such as towing, rental costs, and more.
Caterpillar hasn’t admitted any wrongdoing but agreed to an $8 million settlement to resolve claims in Quebec and Ontario courts. In 2016, the company reached a similar $60 million settlement in United States court.
Under the terms of the settlement fund, Class Members can collect a proportional share of the settlement fund based on if their Caterpillar engines required repairs and, if so, how many qualifying repairs were performed.
Qualifying repairs include repairs or replacements of any Caterpillar regeneration system-related part or component. A list of included parts is available in the settlement agreement.
Even if Class Members’ engines didn’t require repairs, they can collect cash payments of up to $500 per engine. Class Members whose engines required one to five qualifying repairs can collect between $5,000 and $15,000 per engine. Class Members whose engines required six or more qualifying repairs can collect between $10,000 and $30,000.
The deadline for exclusion was Jan. 3, 2022. The deadline for objection is Jan. 12, 2022.
The final approval hearings in the Caterpillar diesel engine lawsuit settlement are scheduled for Jan. 27, 2022, in Quebec court and Jan. 31, 2022, in Ontario court.
In order to benefit from the settlement, Class Members must file a valid claim form by Oct. 25, 2022.
