Canadian Forces Sexual Assault Class Action Settlement Overview:

A $900 million settlement of a class action settlement alleging sexual assault, sexual harassment, and gender discrimination in the Canadian Forces has attracted more than 13,500 claims.

There are just three weeks left until the deadline for claims, which are open to survivors and victims of military sexual misconduct. According to Global News, those who make claims will receive financial compensation for the harms they experienced, allocated at specific amounts, as well as the option to participate in restorative engagement.

Canadian Forces Sexual Assault Class Action Settlement Claims Double

The 2019 settlement was opened for claims in May 2020, and over the last four months the number of claimants has almost doubled

A lawyer representing the survivors, told CBC the dramatic increase was likely due to the claims period coming to an end, and he urged those who needed help filling out claims to reach out before the Nov. 24 deadline.

“If people can’t complete their narrative or if people can’t get all the documents that they need to get in order before then, we can help them with that,” he said.

“We have a team of lawyers here who are available to give people that assistance.”

The lawyer said the claims process was confidential from the Canadian Forces military chain of command, that all claims were being independently evaluated, and that the process was set up with the assumption that claimants were being honest, in an effort to make the class action settlement claims process as trauma-free as possible.

Linna Tam-Seto, a research associate studying military sexual trauma at the Trauma and Recovery Lab of McMaster University, told CBC the increase in Canadian Forces class action settlement claimants could also come down to the national spotlight being firmly fixed on the longstanding issue of military sexual misconduct.

“I think there’s been a lot of hard work amongst the advocacy groups in the community to increase the attention and information base around the class action lawsuit, and I think that has been a really important factor in those increased numbers,” she said.
